LANCMAN, PHEFFER, CHRISTENSEN, ESPAILLAT, MILL- MAN, SPANO, ROSENTHAL, ALFANO, JAFFEE -- Multi-Sponsored by -- M. of A. LATIMER, MAISEL, McDONOUGH, PAULIN, WEISENBERG -- read once and referred to the Committee on Governmental Operations -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT in relation to enacting the "non-profit homeland security preparedness study"; and providing for the repeal of such provisions upon expiration thereof The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. This act shall be known and may be cited as the "non-profit 2 homeland security preparedness study". 3 § 2. Legislative findings and declaration. The legislature hereby 4 finds and declares that New York state is home to thousands of not-for- 5 profit cultural, religious and educational institutions which serve the 6 needs of millions of New Yorkers. A number of these not-for-profit 7 institutions are subject to an increased risk of terrorist attack, and 8 lack the resources and expertise to adequately protect themselves 9 against such threats. 10 This legislation commissions the office of homeland security to study 11 the security needs of those not-for-profit institutions that are subject 12 to increased risk of terrorist attack and registered with the New York 13 State Office of the Attorney General as a not-for-profit institution and 14 report on the universe of federal and state financial resources avail- 15 able to assist those not-for-profit institutions in protecting their 16 facilities and users of their services, and any other strategies for 17 improving security and protecting not-for-profit institutions facing an 18 increased risk of terrorist attack. The office of homeland security shall secure public comment 2 on, study, evaluate and make recommendations in writing to the governor, 3 the temporary president of the senate, and the speaker of the assembly 4 regarding the security needs of not-for-profit institutions facing an 5 increased risk of terrorist attack, the universe of federal and state 6 financial and non-financial resources available to assist those not-for- 7 profit institutions in protecting their facilities and users of their 8 services, and any other strategies for improving security and protecting 9 not-for-profit institutions facing an increased risk of terrorist 10 attack. 11 2. The office of homeland security shall submit its findings and 12 recommendations in writing on or before March 31, 2010. 13 § 4. This act shall take effect immediately and shall expire and be 14 deemed repealed March 31, 2010.
