        AN ACT to amend the education law, in relation to enacting the "New York
          city Caribbean steel pan educational music program act"
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  the "New York city Caribbean steel pan educational music program act".
     3    § 2. Paragraph (c) of subdivision 1 of section 414  of  the  education
     4  law,  as  amended by chapter 345 of the laws of 2009, is amended to read
     5  as follows:
     6    (c) For holding social, civic and  recreational  meetings  and  enter-
     7  tainments,  and  other  uses pertaining to the welfare of the community;
     8  but such meetings, entertainment and uses  shall  be  non-exclusive  and
     9  shall be open to the general public; provided, however, community school
    10  boards in the city of New York shall authorize the use of school grounds
    11  during  the summer months for use by any steel pan music organization to
    12  practice for the Labor Day Parade (West Indian Carnival). Civic meetings
    13  shall include, but not be limited to, meetings  of  parent  associations
    14  and parent-teacher associations.
    15    § 3. Subdivision 27 of section 2590-h of the education law, as amended
    16  by chapter 345 of the laws of 2009, is amended to read as follows:
    17    27.  Promulgate regulations, in conjunction with each community super-
    18  intendent, establishing a plan for providing access to school facilities
    19  in each community school district, when not in use for school  purposes,
    20  in  accordance  with  the provisions of section four hundred fourteen of
    21  this chapter.  Such plan shall include access to school  grounds  during
    22  the  summer months for steel pan music organizations to practice for the
    23  Labor Day Parade (West Indian Carnival). Such plan  shall  set  forth  a
    24  reasonable  system  of  fees  not to exceed the actual costs and specify
    25  that no part of any fee shall  directly  or  indirectly  benefit  or  be

     1  deposited  into an account which inures to the benefit of the custodians
     2  or custodial engineers.
     3    §  4.  Section  2590-h of the education law is amended by adding a new
     4  subdivision 57 to read as follows:
     5    57. Establish steel pan music curriculum or instruction for  community
     6  school  districts.  The  contents  may  be  varied  to meet the needs of
     7  particular community school districts, or portions thereof, and need not
     8  be uniform throughout the city. The content shall be age appropriate and
     9  shall be developed according to the needs and  abilities  of  pupils  at
    10  successive  grade  levels  in order to provide skills and information on
    11  steel pan music.
    12    § 5. This act shall take effect on the ninetieth day  after  it  shall
    13  have  become  a  law;  provided, however, that the amendments to section
    14  2590-h of the education law made by sections three and four of this  act
    15  shall  not  affect  the  expiration  of such section and shall be deemed
    16  repealed  therewith.  Effective  immediately,  the  addition,  amendment
    17  and/or repeal of any rule or regulation necessary for the implementation
    18  of  this  act  on  its  effective  date  are  authorized  to be made and
    19  completed on or before such date.
