AN ACT to amend the penal law, in relation to including offenses against
a school crossing guard to aggravated harassment in the second degree
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 240.30 of the penal law is amended by adding a new
2 subdivision 3-a to read as follows:
3 3-a. With intent to harass, annoy, threaten or alarm another person,
4 he or she strikes, shoves, kicks, or otherwise subjects another person
5 to physical contact, which includes spitting on such other person, and
6 such other person is a school crossing guard appointed pursuant to
7 section two hundred eight-a of the general municipal law; or
8 § 2. This act shall take effect immediately.
