        AN  ACT  in  relation  to authorizing the town of Schroeppel to repay to
          taxpayers monies erroneously received by such  town  as  a  result  of
          overpaid special assessments
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any provision of law to the  contrary,  the
     2  town  of Schroeppel, county of Oswego, is hereby authorized and directed
     3  to refund or credit monies erroneously received by such town as a result
     4  of special assessments collected pursuant to the  2005  assessment  roll
     5  which was prepared on the basis of erroneous budget figures used to fund
     6  water  district  #1,  water  district  #2,  water  district #3 and sewer
     7  district #2 within such town. Such monies erroneously received and to be
     8  repaid by the town of Schroeppel shall be any monies  collected  by  the
     9  county  of  Oswego  for  such  town  and received by such town above the
    10  amount of monies desired to be received  by  such  town  for  each  such

    11  district, as set forth in the following table:

    19    Such  repayment  of  monies  shall  be  made  pursuant to a resolution
    20  adopted by the town board of the town of Schroeppel, and shall  be  made
    21  only  to  taxpayers  who  overpaid taxes as a result of such erroneously

    22  prepared budget and only to the extent that such current owner  overpaid
    23  such taxes.
    24    § 2. This act shall take effect immediately.
