Go to top STATE OF NEW YORK ________________________________________________________________________ 2446 2023-2024 Regular Sessions IN ASSEMBLY January 26, 2023 ___________ Introduced by M. of A. BRONSON -- read once and referred to the Commit- tee on Economic Development AN ACT to amend the alcoholic beverage control law, in relation to ending the local option of towns and cities to prohibit the sale of alcohol; and to repeal certain provisions of such law relating thereto The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The alcoholic beverage control law is amended by adding a 2 new section 132 to read as follows: 3 § 132. Local options on the sale of alcohol prohibited. Within every 4 municipality which had a referendum to prohibit the sale of alcohol 5 under the former article nine of this chapter the sale of alcohol shall 6 be lawful. No municipality shall enact any local law, ordinance, or 7 resolution which prohibits the sale of alcohol within the entirety of 8 such municipality. 9 § 2. Article 9 of the alcoholic beverage control law is REPEALED. 10 § 3. This act shall take effect on the ninetieth day after it shall 11 have become a law.
