AN ACT to amend the penal law, in relation to assault in the second
degree
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 120.05 of the penal law is amended by adding a new
2 subdivision 13 to read as follows:
3 13. Being confined to a secure treatment facility, as such term is
4 defined in subdivision (o) of section 10.03 of the mental hygiene law,
5 and with intent to cause physical injury to an employee of such secure
6 treatment facility performing his or her duties, he or she causes such
7 injury to such person.
8 § 2. This act shall take effect on the first of November next succeed-
9 ing the date on which it shall have become a law.
