AN ACT to amend the social services law, in relation to state supplement
payments and personal needs allowance for eligible individuals receiv-
ing enhanced residential care
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (c) of subdivision 1 of section 131-o of the
2 social services law, as amended by section 1 of part K of chapter 56 of
3 the laws of 2020, is amended to read as follows:
4 (c) in the case of each individual receiving enhanced residential
5 care, an amount equal to at least:
6 (i) $207.00 for each month beginning on or after January first, two
7 thousand [twenty.] twenty-two;
8 (ii) $223.00 for each month beginning on or after April first, two
9 thousand twenty-three;
10 (iii) $243.00 for each month beginning on or after January first, two
11 thousand twenty-four;
12 (iv) $262.00 for each month beginning on or after January first, two
13 thousand twenty-five;
14 (v) $281.00 for each month beginning on or after January first, two
15 thousand twenty-six; and
16 (vi) $300.00 for each month beginning on or after January first, two
17 thousand twenty-seven.
18 § 2. Paragraph (e) of subdivision 2 of section 209 of the social
19 services law, as amended by section 2 of part K of chapter 56 of the
20 laws of 2020, is amended to read as follows:
21 (e) [On and after] (i) (1) From January first, two thousand [twenty]
22 twenty-two to March thirty-first, two thousand twenty-three, [(i)] for
23 an eligible individual receiving enhanced residential care, $1,477.00;
24 and [(ii)] (2) for an eligible couple receiving enhanced residential

1 care, two times the amount set forth in [subparagraph (i)] clause one of
2 this [paragraph] subparagraph.
3 (ii)(1) From April first, two thousand twenty-two to December thirty-
4 first, two thousand twenty-two, for an eligible individual receiving
5 enhanced residential care, $1,484.00; and (2) for an eligible couple
6 receiving enhanced residential care, two times the amount set forth in
7 clause one of this subparagraph.
8 (iii)(1) From January first, two thousand twenty-three to December
9 thirty-first, two thousand twenty-three, for an eligible individual
10 receiving enhanced residential care, $1,504.00; and (2) for an eligible
11 couple receiving enhanced residential care, two times the amount set
12 forth in clause one of this subparagraph.
13 (iv) (1) From January first, two thousand twenty-four to December
14 thirty-first, two thousand twenty-four, for an eligible individual
15 receiving enhanced residential care, $1,523.00; and (2) for an eligible
16 couple receiving enhanced residential care, two times the amount set
17 forth in clause one of this subparagraph.
18 (v) (1) From January first, two thousand twenty-five to December thir-
19 ty-first, two thousand twenty-five, for an eligible individual receiving
20 enhanced residential care, $1,542.00; and (2) for an eligible couple
21 receiving enhanced residential care, two times the amount set forth in
22 clause one of this subparagraph.
23 (vi) (1) From January first, two thousand twenty-six to December thir-
24 ty-first, two thousand twenty-six, for an eligible individual receiving
25 enhanced residential care, $1,561.00; and (2) for an eligible couple
26 receiving enhanced residential care, two times the amount set forth in
27 clause one of this subparagraph.
28 § 3. This act shall take effect on the same date and in the same
29 manner as sections 1 and 2 of part K of chapter 56 of the laws of 2020,
30 takes effect.
