AN ACT to amend the social services law, in relation to monthly grants
and allowances of public assistance; and to repeal certain provisions
of such law relating thereto
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraphs (a), (a-1), (a-2), (a-3) and (a-4) of subdivi-
2 sion 2 of section 131-a of the social services law, paragraph (a) as
3 amended and paragraph (a-1) as added by section 1 of part Y of chapter
4 57 of the laws of 2009, paragraph (a-2) as amended by section 1 of part
5 U of chapter 58 of the laws of 2011, paragraph (a-3) as amended and
6 paragraph (a-4) as added by section 1 of part D of chapter 57 of the
7 laws of 2012, are amended to read as follows:
8 (a) [Through June thirtieth, two thousand nine, the following schedule
9 shall be the standard of monthly need for determining eligibility for
10 all categories of assistance in and by all social services districts:

14 For each additional person in the household there shall be added an
15 additional amount of sixty dollars monthly.
16 (a-1) For the period beginning July first, two thousand nine and
17 ending June thirtieth, two thousand ten, the following schedule shall be
18 the standard of monthly need for determining eligibility for all catego-
19 ries of assistance in and by all social services districts:

1 For each additional person in the household there shall be added an
2 additional amount of sixty-seven dollars monthly.
3 (a-2) For the period beginning July first, two thousand ten and ending
4 June thirtieth, two thousand twelve, the following schedule shall be the
5 standard of monthly need for determining eligibility for all categories
6 of assistance in and by all social services districts:

15 all categories of assistance in and by all social services districts:

23 determining eligibility for all categories of assistance in and by all
24 social services districts:

30 § 2. Paragraphs (a), (a-1), (a-2), (a-3) and (a-4) of subdivision 3 of
31 section 131-a of the social services law, paragraph (a) as amended by
32 and subdivision (a-1) as added by section 2 of part Y of chapter 57 of
33 the laws of 2009, paragraph (a-2) as amended by section 3 of part U of
34 chapter 58 of the laws of 2011, and paragraph (a-3) as amended by and
35 paragraph (a-4) as added by section 2 of part D of chapter 57 of the
36 laws of 2012, are amended to read as follows:
37 (a) [Through June thirtieth, two thousand nine, persons and families
38 determined to be eligible by the application of the standard of need
39 prescribed by the provisions of subdivision two of this section, less
40 any available income or resources which are not required to be disre-
41 garded by other provisions of this chapter, shall receive maximum month-
42 ly grants and allowances in all social services districts, in accordance
43 with the following schedule, for public assistance:

47 For each additional eligible needy person in the household there shall
48 be an additional allowance of sixty dollars monthly.
49 (a-1) For the period beginning July first, two thousand nine and
50 ending June thirtieth, two thousand ten, persons and families determined
51 to be eligible by the application of the standard of need prescribed by
52 the provisions of subdivision two of this section, less any available
53 income or resources which are not required to be disregarded by other
54 provisions of this chapter, shall receive maximum monthly grants and
55 allowances in all social services districts, in accordance with the
56 following schedule, for public assistance:

32 (a-4)] For the period beginning October first, two thousand twelve and
33 thereafter, persons and families determined to be eligible by the appli-
34 cation of the standard of need prescribed by the provisions of subdivi-
35 sion two of this section, less any available income or resources which
36 are not required to be disregarded by other provisions of this chapter,
37 shall receive maximum monthly grants and allowances in all social
38 services districts, in accordance with the following schedule, for
39 public assistance:

43 For each additional person in the household there shall be added an
44 additional amount of eighty-five dollars monthly.
45 § 3. Subparagraphs (ii) and (iii) of paragraph (a) of subdivision 8 of
46 section 131-a of the social services law, subparagraph (ii) as amended
47 by section 12 of part B of chapter 436 of the laws of 1997 and subpara-
48 graph (iii) as amended by chapter 246 of the laws of 2002, are amended
49 to read as follows:
50 (ii) from the earned income of any child or relative applying for or
51 receiving aid pursuant to such program, or of any other individual
52 living in the same household as such relative and child whose needs are
53 taken into account in making such determination, the first [ninety] two
54 hundred dollars of the total of such earned income for such month;
55 (iii) [forty-two] sixty-seven percent of the earned income for such
56 month of any applicant or recipient [in a household containing a depend-

1 ent child] which remains after application of all other subparagraphs of
2 this paragraph[; provided, however, that such percentage amount shall be
3 adjusted in June of each year, commencing in nineteen hundred ninety-
4 eight, to reflect changes in the most recently issued poverty guidelines
5 of the United States Bureau of the Census, such that a household of
6 three without special needs, living in a heated apartment in New York
7 city and without unearned income would become ineligible for assistance
8 with gross earnings equal to the poverty level in such guidelines;]
9 provided, however, that no assistance shall be given to any household
10 with gross earned and unearned income, exclusive of income described in
11 subparagraphs (i) and (vi) of this paragraph, in excess of such poverty
12 level;
13 § 4. Subdivision 10 of section 131-a of the social services law is
14 REPEALED.
15 § 5. This act shall take effect on the first of April next succeeding
16 the date on which it shall have become a law.
