AN ACT to amend the public authorities law and the environmental conser-
vation law, in relation to the construction of a pipeline property
under the control of the New York state thruway authority
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 389 to read as follows:
3 § 389. Pipeline limitation. Notwithstanding the provisions of subdivi-
4 sion eleven of section three hundred fifty-four of this title or any
5 other law, rule or regulation to the contrary, the authority shall not
6 construct or maintain or enter into any lease or contract for the
7 construction or maintenance of or grant any permit or easement in
8 connection with the construction of a longitudinal pipeline designed to
9 carry hazardous substances or petroleum, extending further than five
10 miles in length along property under the control of the authority.
11 § 2. The environmental conservation law is amended by adding a new
12 section 3-321 to read as follows:
13 § 3-321. Pipeline limitation.
14 Notwithstanding any law, rule or regulation to the contrary, the
15 department shall not approve any application for any permit, certif-
16 ication or authorization in connection with the construction of a longi-
17 tudinal pipeline designed to carry hazardous substances or petroleum,
18 extending further than five miles in length along property under the
19 control of the New York state thruway authority.
20 § 3. This act shall take effect immediately.
