Relates to excepting certain persons or entities from indemnity bonds or insurance policy requirements when renting or leasing rental vehicles to film or television production companies; provides that rental car companies are not subject to certain corporate surety bond or liability insurance coverage requirements when renting to a film or television production company when such production company purchases insurance that complies with surety bond or insurance requirements.

AN ACT to amend the vehicle and traffic law, in relation to excepting
certain persons or entities from indemnity bonds or insurance policy
requirements when renting or leasing rental vehicles to film or tele-
vision production companies
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The opening paragraph of subdivision 3 of section 370 of
2 the vehicle and traffic law, as amended by chapter 232 of the laws of
3 2001, is amended to read as follows:
4 A person, firm, association or corporation engaged in the business of
5 renting or leasing rental vehicles to be operated upon the public high-
6 ways for carrying passengers shall be subject to the provisions of this
7 section in the same manner and to the same extent as if such person,
8 firm, association or corporation were actually engaged in the business
9 of carrying or transporting passengers for hire; provided, however, any
10 person, firm, association or corporation engaged in the business of
11 renting or leasing rental vehicles to any film or television production
12 company shall not be subject to the corporate surety bond or liability
13 insurance coverage requirements of this section, provided such person,
14 firm, association or corporation files with the commissioner of motor
15 vehicles, in such form as the commissioner may prescribe, evidence that
16 such film or television production company has purchased a policy of
17 insurance on such rented or leased rental vehicles that complies with
18 the requirements of this section. For the purposes of this section,
19 "film or television production company" means a corporation, partner-
20 ship, limited partnership, or other entity or individual which or who is
21 principally engaged in the production of a feature-length film, tele-
22 vision film, television pilot and/or each episode of a television
23 series, regardless of the medium by means of which the film, pilot or

1 episode is created or conveyed, and controls the film, pilot or episode
2 during production.
3 § 2. This act shall take effect on the ninetieth day after it shall
4 have become a law; provided, however, that effective immediately, the
5 addition, amendment and/or repeal of any rule or regulation necessary
6 for the implementation of this act on its effective date are authorized
7 and directed to be made and completed on or before such effective date.
