        Introduced by M. of A. GOTTFRIED, SANTABARBARA -- read once and referred
          to the Committee on Health
 
        AN ACT to amend the social services law, in relation to timely filing of
          Medicaid claims
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 8 of section 367-b of the social  services  law
     2  is amended by adding a new paragraph (d) to read as follows:
     3    (d)  The  commissioner  shall provide by regulation for a delay reason
     4  code to allow the filing and paying of otherwise-valid  medical  assist-
     5  ance  claims  that are not submitted in accordance with the department's
     6  timely filing requirements  due  to  the  implementation  of  a  new  or
     7  upgraded electronic medical record system.
     8    §  2.  This  act shall take effect on the ninetieth day after it shall
     9  become a law. The commissioner of health shall make regulations and take
    10  other actions reasonably necessary to implement this act on  its  effec-
    11  tive date.
