        AN ACT to amend the general business law, in relation to private  infor-
          mation
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph (b) of subdivision 1 of  section  899-aa  of  the
     2  general  business  law,  as added by chapter 442 of the laws of 2005, is
     3  amended to read as follows:
     4    (b) "Private information" shall mean personal  information  consisting
     5  of  any information in combination with any one or more of the following
     6  data elements, when either the personal information or the data  element
     7  is not encrypted, or encrypted with an encryption key that has also been
     8  acquired:
     9    (1) social security number;
    10    (2)  driver's license number or non-driver identification card number;
    11  [or]
    12    (3) account number, credit or debit card number[, in combination  with
    13  any  required  security code, access code, or password that would permit
    14  access to an individual's financial account]; or
    15    (4) birthdates, home addresses, or phone numbers, or  any  combination
    16  thereof;
    17    "Private  information" does not include publicly available information
    18  which is lawfully made available to the  general  public  from  federal,
    19  state, or local government records.
    20    § 2. This act shall take effect immediately.
