        AN ACT to amend the penal law, in relation to establishing  the  offense
          of unlawful obstruction of law enforcement identification
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The penal law is amended by adding a new section 270.40  to
     2  read as follows:
     3  § 270.40 Unlawful obstruction of law enforcement identification.
     4    1. A person is guilty of unlawful obstruction of law enforcement iden-
     5  tification  when, with intent to prevent the inspection of any part of a
     6  law enforcement officer's uniform which identifies him or her as  a  law
     7  enforcement officer including his or her name, shield, badge, numbers or
     8  other  identifying  insignias  or  emblems, he or she covers or conceals
     9  such name, shield, badge, numbers  or  other  identifying  insignias  or
    10  emblems from public view.
    11    2.  For  the purposes of this section, "law enforcement officer" shall
    12  include any public servant, federal  or  state,  who  is  authorized  to
    13  conduct an investigation or make an arrest for a criminal offense.
    14    Unlawful  obstruction  of  law enforcement identification is a class A
    15  misdemeanor.
    16    § 2. This act shall take effect immediately.
