AN ACT to amend the environmental conservation law, in relation to the
sale of state lands
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The environmental conservation law is amended by adding a
2 new section 49-0217 to read as follows:
3 § 49-0217. Sale of state-owned land.
4 1. Prior to the disposition of state-owned land by state agencies and
5 authorities, the state land acquisition advisory council, established
6 pursuant to section 49-0211 of this title, shall review any such state-
7 owned land to determine:
8 (a) if it is within a resource protection area as designated by the
9 state land acquisition plan, pursuant to section 49-0207 of this title;
10 (b) if it meets a category definition contained in the state land
11 acquisition plan, pursuant to section 49-0207 of this title; or
12 (c) if it receives a minimum score, above the cutoff, using the appro-
13 priate rating system as defined in the state land acquisition plan,
14 pursuant to section 49-0207 of this title.
15 2. If any of the criteria, as described in paragraphs (a), (b) and (c)
16 of subdivision one of this section, are met, such land shall be trans-
17 ferred to the department. The department shall manage such land in
18 accordance with the recommendations of the state land acquisition plan,
19 pursuant to section 49-0207 of this title.
20 § 2. This act shall take effect immediately.
