AN ACT to establish a report on arts and music education in elementary
and secondary schools; and providing for the repeal of such provisions
upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. 1. The commissioner of education shall: (a) create a proce-
2 dure in which school district compliance with current arts education and
3 instruction requirements including visual arts, music, dance and thea-
4 tre, hereinafter referred to in this act as "arts education instruc-
5 tion", as required by law and regulation in elementary and secondary
6 public schools is reported to the state education department by school
7 districts for the purposes of preparing the report provided for by
8 subdivision two of this section; and (b) provide suggestions on how the
9 current arts education instruction requirements could be improved or
10 enhanced.
11 2. The state education department shall prepare a report that must
12 include, but not be limited to, the following:
13 (a) how the state standards, including statutory and regulatory
14 requirements, for arts education instruction could be revised or altered
15 to better promote education and appreciation of the arts and music in
16 elementary and secondary schools;
17 (b) how the state standards, including statutory and regulatory
18 requirements, for arts education instruction could be revised or altered
19 to increase the time devoted to providing instruction and education for
20 such arts;
21 (c) i. the impacts that arts education instruction has on enhancing
22 pupil academic performance;

1 ii. how integrating the arts education instruction into general educa-
2 tion throughout the learning process, could enhance students' learning
3 capabilities.
4 3. On or before July 1, 2021, the commissioner of education shall
5 report to the governor, the temporary president of the senate, the
6 speaker of the assembly, and the chairs of the senate and assembly
7 committees on education the findings made based on the information
8 reported pursuant to subdivision one of this section including an analy-
9 sis and explanation of the data, and shall identify steps that should be
10 taken to ensure that all public schools are in compliance with arts
11 education instruction requirements in elementary and secondary grades
12 and examine, evaluate and make recommendations concerning the adequacy
13 of the current state standards for arts education and instruction for
14 elementary and secondary schools in the state. Such recommendations may
15 include but not be limited to revisions or alterations to the state
16 standards for arts education and instruction to better promote and
17 increase time devoted to providing such instruction.
18 § 2. This act shall take effect immediately, and shall expire and be
19 deemed repealed January 1, 2022 or on the one hundred eightieth day
20 after the report required by subdivisions two and three of section one
21 of this act is submitted to the governor, the temporary president of the
22 senate, the speaker of the assembly, and the chairs of the senate and
23 assembly committees on education, whichever shall be later; provided,
24 further, that the state education department shall notify the legisla-
25 tive bill drafting commission upon the submission of the report required
26 by subdivisions two and three of section one of this act to the gover-
27 nor, the temporary president of the senate, the speaker of the assembly,
28 and the chairs of the senate and assembly committees on education, in
29 order that the commission may maintain an accurate and timely effective
30 data base of the official text of the laws of the state of New York in
31 furtherance of effectuating the provisions of section 44 of the legisla-
32 tive law and section 70-b of the public officers law.
