        AN  ACT  to  amend  the  public  health  law,  in relation to permitting
          specialist assistants to prescribe controlled substances as a  practi-
          tioner
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public health law is amended by adding  a  new  section
     2  3712 to read as follows:
     3    §  3712.  Prescriptions  for  controlled  substances.    A  registered
     4  specialist assistant, in good faith and acting within his or her  lawful
     5  scope  of practice, and to the extent assigned by his or her supervising
     6  physician, may prescribe controlled substances as a  practitioner  under
     7  article thirty-three of this chapter, to patients under the care of such
     8  physician  responsible  for his or her supervision. The commissioner, in
     9  consultation with the commissioner of  education,  may  promulgate  such
    10  regulations as are necessary to carry out the purposes of this section.
    11    § 2. This act shall take effect on the one hundred eightieth day after
    12  it  shall have become a law. Effective immediately, the addition, amend-
    13  ment and/or repeal of any rule or regulation necessary for the implemen-
    14  tation of this act on its effective date are authorized to be  made  and
    15  completed on or before such effective date.
