        AN ACT to amend the social services law, in relation to authorizing  the

          office  of  children  and  family  services  to establish differential
          market rates applicable to accredited child care programs
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.    Section  390  of  the social services law is amended by
     2  adding a new subdivision 12-a to read as follows:
     3    12-a. The office of children  and  family  services  shall  promulgate
     4  rules  and regulations establishing differential market rates applicable
     5  to child care programs accredited by the national  association  for  the
     6  education  of  young  children, the national association of family child
     7  care or any other nationally recognized  child  care  accrediting  body.

     8  Such  programs  shall  receive a reimbursement rate for the provision of
     9  child care services that is up to fifty percent higher  than  the  local
    10  market rate set forth by such office.
    11    § 2. This act shall take effect on the one hundred eightieth day after
    12  it shall have become a law.
