        AN ACT to amend the civil service law, in relation to the maximum age of
          certain persons applying for provisional or permanent  appointment  as
          fire fighters
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 58-a of the civil service law,  as
     2  amended  by  section  1 of part A of chapter 101 of the laws of 2013, is
     3  amended to read as follows:
     4    1. Notwithstanding any other provision of this  law  or  any  general,
     5  special  or  local  law to the contrary, no person shall be eligible for
     6  provisional or permanent appointment in the  competitive  class  of  the
     7  civil service as a fire fighter unless he or she shall:
     8    (a)  satisfy the basic requirements for education, health and physical
     9  fitness established by the state fire administrator pursuant to  section
    10  one hundred fifty-eight of the executive law; and
    11    (b)  is  not  more than twenty-nine years of age on the date he or she
    12  takes  the  written  competitive  examination  for   such   appointment;
    13  provided,  however,  that the time spent on military duty or on terminal
    14  leave, not exceeding a total of seven years shall be subtracted from the
    15  age of any applicant who has passed his or her twenty-ninth birthday  as
    16  provided  in subdivision ten-a of section two hundred forty-three of the
    17  military law.
    18    § 2. This act shall take effect on the thirtieth day  after  it  shall
    19  have become a law and shall apply to an eligible list for appointment in
    20  the  competitive class of civil service as a fire fighter established on
    21  or after such date.
