        AN ACT to amend the penal law, in relation to the  regulation  of  pseu-
          doephedrine
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1.  Section 220.72 of the penal law, as added by  chapter  394
     2  of the laws of 2005, is amended to read as follows:
     3  § 220.72 Criminal possession of precursors of methamphetamine.
     4    1.  A  person  is guilty of criminal possession of precursors of meth-
     5  amphetamine when he or she possesses at the same time a precursor and  a
     6  solvent  or chemical reagent, with intent to use or knowing that another
     7  intends to use each such  precursor,  solvent  or  chemical  reagent  to
     8  unlawfully manufacture methamphetamine.
     9    [Criminal  possession of precursors of methamphetamine] 2. It shall be
    10  illegal and a violation of subdivision  one  of  this  section  for  any
    11  person to purchase or sell an amount in excess of 3.6 grams a day or 9.0

    12  grams per month of pseudoephedrine without regard to the number of tran-
    13  sactions.
    14    3.  Any violation of subdivision one or two of this section is a class
    15  E felony.
    16    § 2. This act shall take effect immediately.
