AN ACT to amend the administrative code of the city of New York, in
relation to requirements on the construction of new housing for school
district purposes
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The administrative code of the city of New York is amended
2 by adding a new section 28-105.12.9 to read as follows:
3 § 28-105.12.9 Disclosure of community school district information. Any
4 application submitted to the commissioner pursuant to section 28-105.5
5 of this article for a permit for the construction of any new dwelling,
6 as defined in subdivision four of section four of the multiple dwelling
7 law, or for the addition to, change of use or occupancy of, or reno-
8 vation to an existing building that will cause it to have dwelling
9 units, shall specify: (1) the community school district in which the
10 dwelling or dwelling units are located; (2) the number of families that
11 will occupy the dwelling or dwelling units; and (3) an estimate of the
12 number of children of compulsory school age, as defined in subdivision
13 eleven of section two of the education law, that will occupy the dwell-
14 ing or dwelling units. No later than ten days after the approval of the
15 application for the permit, the commissioner shall forward such informa-
16 tion to the New York city department of education.
17 The department of buildings, in conjunction with the department of
18 city planning, shall promulgate regulations for determining the number
19 of estimated children and families authorized to occupy each new dwell-
20 ing or dwelling unit.
21 § 2. This act shall take effect on the one hundred twentieth day after
22 it shall have become a law.
