AN ACT to amend the election law, in relation to reducing the numbers of
signatures for designating petitions; and providing for the repeal of
such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 2 of section 6-136 of the election law, as
2 amended by chapter 79 of the laws of 1992, the opening paragraph as
3 amended by chapter 659 of the laws of 1994 and paragraph (c-1) as
4 amended by chapter 418 of the laws of 1993, is amended to read as
5 follows:
6 2. All other petitions must be signed by not less than [five] one and
7 one-half per centum, as determined by the preceding enrollment, of the
8 then enrolled voters of the party residing within the political unit in
9 which the office or position is to be voted for (excluding voters in
10 inactive status), provided, however, that for the following public
11 offices the number of signatures need not exceed the following limits:
12 (a) [For] Notwithstanding any provision of the New York city charter
13 providing for greater thresholds to the contrary, for any office to be
14 filled by all voters of the city of New York, [seven thousand five
15 hundred] two thousand two hundred fifty signatures;
16 (b) [For] Notwithstanding any provision of the New York city charter
17 providing for greater thresholds to the contrary, for any office to be
18 filled by all the voters of any county or borough within the city of New
19 York, [four thousand] one thousand two hundred signatures;
20 (c) [For] Notwithstanding any provision of the New York city charter
21 providing for greater thresholds to the contrary, for any office to be
22 filled in the city of New York by all the voters of any municipal court
23 district, [one thousand five hundred] four hundred fifty signatures;

1 (c-1) [For] Notwithstanding any provision of the New York city charter
2 providing for greater thresholds to the contrary, for any office to be
3 filled in the city of New York by all the voters of any city council
4 district, [nine hundred] two hundred seventy signatures;
5 (d) For any office to be filled by all the voters of cities or coun-
6 ties, except the city of New York and counties therein, containing more
7 than two hundred fifty thousand inhabitants according to the last
8 preceding federal enumeration, [two thousand] six hundred signatures;
9 (e) For any office to be filled by all the voters of cities or coun-
10 ties containing more than twenty-five thousand and not more than two
11 hundred fifty thousand inhabitants, according to the last preceding
12 federal enumeration, [one thousand] three hundred signatures;
13 (f) For any office to be filled by all the voters of any other city or
14 county, or of a councilmanic district in any city other than the city of
15 New York, [five hundred] one hundred fifty signatures;
16 (g) For any office to be filled by all the voters of any congressional
17 district, [twelve hundred fifty] three hundred seventy-five signatures;
18 (h) For any office to be filled by all the voters of any state senato-
19 rial district, [one thousand] three hundred signatures;
20 (i) For any office to be filled by all voters of any assembly
21 district, [five hundred] one hundred fifty signatures;
22 (j) For any office to be filled by all the voters of any political
23 subdivision, except as herein otherwise provided, contained within
24 another political subdivision, not to exceed the number of signatures
25 required for the larger subdivision;
26 (k) For any other office to be filled by the voters of a political
27 subdivision containing more than one assembly district, county or other
28 political subdivision, not to exceed the aggregate of the signatures
29 required for the subdivisions or parts of subdivisions so contained; and
30 (l) For any county legislative district, [five hundred] one hundred
31 fifty signatures.
32 § 2. Notwithstanding subdivision 4 of section 6-134 of the election
33 law, the first day to sign a designating petition shall be March 2,
34 2021.
35 § 3. Notwithstanding subdivision 1 of section 6-158 of the election
36 law, a designating petition for the June 2021 primary election shall be
37 filed with the appropriate board of elections on March 22 through March
38 25, 2021 and the political calendar with respect to objections, accept-
39 ances, authorizations, declinations, substitutions and the last day to
40 commence an election law article 16 proceeding shall be adjusted accord-
41 ingly.
42 § 4. This act shall take effect immediately and shall not apply to any
43 special election that will occur in the city of New York for which
44 petitions are required to be filed before February 15, 2021 and shall
45 expire December 31, 2021, when upon such date the provisions of this act
46 shall be deemed repealed.
