Authorizes and directs the commissioner of health to establish a one year screening program for all blood donations to screen such donations for the presence of babesia microti and to make a report and recommendations based upon the results of such program; and providing for the repeal of such provisions upon the expiration thereof.

AN ACT to amend the public health law, in relation to screening blood
donations for babesia microti; and providing for the repeal of such
provisions upon the expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public health law is amended by adding a new section
2 3121-a to read as follows:
3 § 3121-a. Temporary screening of blood donations for babesia microti.
4 1. The commissioner is hereby authorized and directed to establish a one
5 year screening program for all blood donations to screen such donations
6 for the presence of babesia microti. The commissioner shall consult with
7 the American Red Cross when designing such program.
8 2. The commissioner shall, within ninety days of the conclusion of the
9 babesia microti screening program, report the findings and conclusions
10 of such program to the governor, temporary president of the senate,
11 speaker of the assembly and the council on human blood and transfusion
12 services. Such report shall include recommendations on whether all blood
13 donations should be screened for babesia microti on a permanent basis.
14 § 2. The temporary screening of blood donations for babesia microti
15 required by section one of this act shall be established and all donated
16 blood shall be screened for babesia microti commencing within one
17 hundred eighty days from the date this act shall have become a law.
18 § 3. This act shall take effect immediately and shall expire and be
19 deemed repealed two years after such date.
