Authorizes the commissioner of motor vehicles to issue temporary visitor's driver's licenses to certain foreign nationals who are unable to present documentation from the United States Citizenship and Immigration Services authorizing the person's presence in this country.

AN ACT to amend the vehicle and traffic law, in relation to authorizing
he issuance of temporary visitor's driver's licenses
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 501-c to read as follows:
3 § 501-c. Temporary visitor's driver's license. 1. (a) The commissioner
4 may issue a temporary visitor's driver's license to a foreign national
5 who:
6 (i) resides in this state;
7 (ii) is ineligible to obtain a social security number; and
8 (iii) presents to the commissioner documentation, issued by United
9 States Citizenship and Immigration Services, authorizing the person's
10 presence in this country.
11 (b) The commissioner may issue a temporary visitor's driver's license
12 to an applicant who:
13 (i) has resided in this state for a period in excess of one year;
14 (ii) is ineligible to obtain a social security number; and
15 (iii) is unable to present documentation issued by the United States
16 Citizenship and Immigration Services authorizing the person's presence
17 in this country provided that such applicant shall submit a valid unex-
18 pired passport from the applicant's country of citizenship or a valid
19 unexpired consular identification document issued by a consulate of that
20 country.
21 (c) Applicants for a temporary visitor's driver's license who are
22 under eighteen years of age at the time of application shall be subject
23 to the provisions of section five hundred one and five hundred one-b of
24 this article.

1 2. (a) A temporary visitor's driver's license issued under paragraph
2 (a) of subdivision one of this section shall be valid for three years,
3 or for the period of time the individual is authorized to remain in this
4 country, whichever ends sooner.
5 (b) A temporary visitor's driver's license issued under paragraph (b)
6 of subdivision one of this section shall be valid for a period of three
7 years.
8 3. A temporary visitor's driver's license issued under this section
9 may not be accepted for proof of the holder's identity. A temporary
10 visitor's driver's license issued under this section shall contain a
11 notice on its face, in capitalized letters, stating that the temporary
12 visitor's driver's license may not be accepted for proof of identity.
13 4. The commissioner shall adopt any rule or regulations necessary to
14 implement this section, including rules or regulations:
15 (a) regarding the design and content of the temporary visitor's driv-
16 er's licenses;
17 (b) establishing criteria for proof of identification and residency of
18 an individual applying under paragraph (b) of subdivision one of this
19 section;
20 (c) designating acceptable evidence that an applicant is not eligible
21 for a social security number;
22 (d) regarding the issuance of temporary visitor's driver's licenses
23 for applicants who are eighteen years of age or younger in accordance
24 with the provisions of this article; and
25 (e) regarding the issuance of temporary visitor's learner's permits in
26 accordance with the provisions of this article.
27 5. Any person to whom the commissioner shall issue a temporary visi-
28 tor's driver's license shall be subject to all rules and regulations
29 issued by the commissioner, the provisions of this chapter and any other
30 laws of the state pertaining to the maintenance and operation of motor
31 vehicles to the same extent as any person issued a driver's license
32 under section five hundred one of this article.
33 6. A temporary visitor's driver's licenses shall be invalid if the
34 holder is unable to provide a proof of liability insurance upon the
35 request of a law enforcement officer.
36 7. Temporary visitor's driver's licenses shall be issued from a
37 central location after the commissioner has verified the information
38 provided by the applicant.
39 § 2. This act shall take effect on the one hundred eightieth day after
40 it shall have become a law, provided, however, that effective immediate-
41 ly the addition and/or repeal of any rule or regulation necessary for
42 the implementation of this act on its effective date are authorized and
43 directed to be made and completed on or before such effective date.
