        AN ACT to amend the alcoholic  beverage  control  law,  in  relation  to
          prohibiting  the  granting of a license for the retail sale of alcohol
          beverages for on-premises or off-premises consumption to any  premises
          upon which there exists a drive-up or drive-through facility
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 105  of  the  alcoholic  beverage  control  law  is
     2  amended by adding a new subdivision 4 to read as follows:
     3    4.  No  retail  license to sell alcoholic beverages for on-premises or
     4  off-premises consumption shall be granted for any  premises  upon  which
     5  there exists a drive-up or drive-through facility.
     6    §  2.  This  act  shall  take  effect  immediately, and shall apply to

     7  licenses issued or renewed on or after such date.
