        AN  ACT  to  amend  the  executive law, in relation to qualifications to
          serve as an emergency medical technician
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1.  The executive law is amended by adding a new section 837-s
     2  to read as follows:
     3    §  837-s.  Search  for  sex  offense  conviction  records of emergency
     4  medical technician and other first responder applicants.  1.  The  chief
     5  officer  of  any volunteer ambulance company, as such term is defined in
     6  subdivision two of section three of  the  volunteer  ambulance  workers'
     7  benefit  law,  any proprietary ambulance service, or any other ambulance
     8  or emergency medical service providing emergency medical care and trans-
     9  portation of sick or injured persons to health  care  facilities,  shall
    10  notify  every new applicant for emergency medical technician, paramedic,
    11  certified first responder applicant, or any other applicant who would be
    12  responsible for providing emergency medical care and  transportation  of
    13  sick  or injured persons to health care facilities, including applicants
    14  seeking to transfer from one ambulance company or  service  to  another,
    15  that  their  personally  identifying information will be checked against
    16  the public records of those individuals required to register under arti-
    17  cle six-C of the correction law.

     1    2. If such applicant desires to proceed, within ten business  days  of
     2  receiving  an  application, the chief officer shall inquire of the divi-
     3  sion as to whether such applicant is required to register by calling the
     4  special telephone number established pursuant  to  section  one  hundred
     5  sixty-eight-p  of  the correction law. Such chief officer may also check
     6  the internet posting subdirectory of level two and three  sex  offenders
     7  established  pursuant  to  section  one  hundred  sixty-eight-q  of  the
     8  correction law.
     9    3. Where such search reveals that an  applicant  is  registered  under
    10  article  six-C of the correction law, the chief officer of the ambulance
    11  company or service shall determine whether or not such person  shall  be
    12  eligible  to be elected or otherwise appointed as a member of such ambu-
    13  lance company or service. Such determination shall  be  made  consistent
    14  with  article  twenty-three-A  of  the correction law and a copy of such
    15  article shall be provided to the applicant.
    16    § 2. This act shall take effect on the one hundred twentieth day after
    17  it shall have become a law.
