AN ACT to amend the public authorities law, in relation to converting
certain vehicles of the metropolitan transportation authority to
alternative fuel vehicles
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The public authorities law is amended by adding a new
2 section 1269-e to read as follows:
3 § 1269-e. Submission of long-range strategic plan to convert existing
4 diesel bus fleet to alternative fuel vehicles. 1. The authority shall
5 formulate and annually update a long-range strategic plan devised to
6 convert the existing diesel bus fleet to an alternative fuel vehicle
7 fleet. Such long-range strategic plan shall be developed for the
8 purposes of promoting improved air quality, providing safe and efficient
9 public transportation at a reasonable cost to riders, advancing environ-
10 mental equity, supporting statewide transit industries, and adopting
11 alternative fuels as a comparable energy source for surface transporta-
12 tion. The authority shall also make any necessary revisions to such plan
13 as deemed appropriate.
14 2. The authority shall submit such a plan to the governor, the tempo-
15 rary president of the senate and the speaker of the assembly on or
16 before January first, two thousand eleven, and thereafter shall submit
17 annual updates and appropriate revisions of such plan to the aforemen-
18 tioned recipients. Such a plan shall include but not be limited to:
19 a. a detailed strategy outlining the goals and objectives of convert-
20 ing the transit authority's existing diesel bus fleet to alternative
21 fuel vehicles;

1 b. a detailed status and inventory of the authority's existing bus
2 fleet including fleet age, likely replacement schedules, numbers of
3 vehicles, years of service per vehicle, and costs;
4 c. a schedule of projected bus replacements and purchases;
5 d. the financial resources necessary to achieve the goals and objec-
6 tives of the long-range plan;
7 e. anticipated infrastructure needs such as numbers and locations of
8 fueling stations, appropriate maintenance needs, and safety consider-
9 ations; and
10 f. any other information the authority deems necessary and appropri-
11 ate.
12 3. In formulating such a plan, and any annual updates and revisions to
13 such plan, the authority:
14 a. shall conduct an appropriate number of hearings so as to allow for
15 adequate public participation and discussion;
16 b. may consult with and cooperate with (i) officials of departments,
17 agencies, or public corporations of the state having duties and respon-
18 sibilities concerning public transportation, environmental quality,
19 environmental equity, transit industries, and/or energy policy;
20 (ii) officials and representatives of the federal government, of
21 neighboring states and of interstate agencies on problems, remedies and
22 solutions necessary to effectuate the goals and objectives of the plan;
23 and
24 (iii) persons, organizations and groups utilizing, served by, inter-
25 ested in or concerned with public transportation, environmental quality,
26 environmental equity, transit industries and/or energy policy;
27 c. may request and receive from any department, division, board,
28 bureau, commission, public authority, or other agency of the state or
29 any political subdivision thereof or any public authority such assist-
30 ance and data as may be necessary to enable the authority to carry out
31 its responsibilities under this section.
32 4. Each annual update of the plan shall include a status report summa-
33 rizing the extent to which the planned goals and objectives of the plan
34 developed for the previous year were achieved, the causes of any failure
35 to achieve projected goals and objectives, and corrective measures the
36 authority intends to take to avoid non-achievement of goals and objec-
37 tives set for the next upcoming year and subsequent years.
38 5. The authority shall take into consideration any petition from local
39 officials for improved implementation of such plan and shall consult
40 with appropriate local officials and organizations in its preparation,
41 annual updates and periodic revisions to the long-range strategic plan.
42 § 2. This act shall take effect on the first of October next succeed-
43 ing the date on which it shall have become a law.
