AN ACT to establish a temporary state commission to rename any projects,
infrastructure, facilities or sites within the state which are named
after or include any reference to Robert Moses; and providing for the
repeal of such provisions upon expiration thereof
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The commissioner of the New York state office of parks,
2 recreation and historic preservation, is hereby authorized to create a
3 temporary state commission, hereafter referred to as the commission, to
4 rename any projects, infrastructure, facilities or sites within the
5 state which are named after or include any reference to Robert Moses,
6 including, but not limited to, statues, schools, parks, playgrounds,
7 roadways and beaches.
8 § 2. (a) The commission shall consist of seven members, to be
9 appointed as follows: one member to be appointed by the governor; three
10 members to be appointed by the temporary president of the senate,
11 consisting of two members from the majority party and one member from
12 the minority party; and three members to be appointed by the speaker of
13 the assembly, consisting of two members from the majority party and one
14 member from the minority party. Each member appointed pursuant to this
15 section shall be one of a local official, civic leader or park official.
16 Vacancies in the membership of the commission and among its officers
17 shall be filled in the manner provided for original appointments or
18 designations. Such appointments shall be made within six months of the
19 effective date of this act.
20 (b) All departments or agencies of the state or subdivisions thereof
21 shall, at the request of the commission, provide such facilities,
22 assistance, and data as will enable the commission to carry out its
23 powers and duties.

1 § 3. (a) For the accomplishment of its purposes, the commission may
2 meet and hold public and/or private hearings within or without the state
3 and shall have all the powers of a legislative committee pursuant to the
4 legislative law. The commission is authorized to consult with community
5 leaders and empowered to undertake any studies, inquiries, surveys or
6 analyses it may deem relevant through its own personnel or in cooper-
7 ation with or by agreement with any other public or private agency. The
8 commission shall consult with other departments or agencies of the state
9 or subdivisions thereof as necessary when the renaming of a project,
10 piece of infrastructure, facility or site involves such other depart-
11 ments or agencies of the state or subdivisions thereof.
12 (b) To the maximum extent feasible, the commission may request and
13 shall be entitled to receive and shall utilize and be provided with such
14 facilities, resources and data from any court in the state and from any
15 subdivision, department, board, bureau, commission, office, agency or
16 other instrumentality of the state or of any political subdivision ther-
17 eof as it deems necessary or desirable for the proper execution of its
18 powers and duties and to effectuate the purposes set forth in this act.
19 (c) The commission is hereby authorized and empowered to enter into
20 any agreements and to do and perform any acts that may be necessary,
21 desirable or proper to carry out the purposes and objectives of this
22 act.
23 § 4. (a) The commission shall make and submit their name recommenda-
24 tions to the commissioner of the New York state office of parks, recre-
25 ation and historic preservation, the temporary president of the senate
26 and the speaker of the assembly. Such recommendations shall be made
27 within six months after all members of the commission have been
28 appointed pursuant to paragraph (a) of section two of this act.
29 (b) Once such recommendations are received and decided upon, the
30 commissioner of the New York state office of parks, recreation and
31 historic preservation shall take all necessary steps to proceed with
32 such renaming. Where applicable, the commissioner shall work in conjunc-
33 tion with other departments or agencies of the state or subdivisions
34 thereof to proceed with such renaming.
35 § 5. This act shall take effect immediately and shall expire and be
36 deemed repealed on the first date next succeeding the date of the renam-
37 ing of all projects, infrastructure, facilities or sites within the
38 state which are named after or include any reference to Robert Moses as
39 required under this act; and provided further, however, that the commis-
40 sioner of the New York state office of parks, recreation and historic
41 preservation shall notify the legislative bill drafting commission upon
42 the renaming of all projects, infrastructure, facilities or sites within
43 the state which are named after or include any reference to Robert Moses
44 as required under this act in order that the commission may maintain an
45 accurate and timely effective data base of the official text of the laws
46 of the state of New York in furtherance of effecting the provisions of
47 section 44 of the legislative law and section 70-b of the public offi-
48 cers law.
