        Introduced  by M. of A. RA -- read once and referred to the Committee on
          Correction
 
        AN ACT to amend the correction law, in relation  to  prohibiting  regis-
          tered sex offenders from residing in certain locations
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Section 168-w of the correction law, as relettered by chap-
     2  ter 604 of the laws of 2005, is  relettered  section  168-x  and  a  new
     3  section 168-w is added to read as follows:
     4    §  168-w.  Registered  sex  offender  residence  limitation. 1. No sex
     5  offender required to register under this article shall reside within one
     6  thousand feet of the boundaries of any  public  or  private  elementary,
     7  secondary or vocational school, or with five hundred feet of the bounda-
     8  ry  of  any public park, or within two thousand feet of the residence of
     9  the victim of the registered sex offender.
    10    2. "Boundaries of any school" means in, on  or  within  any  building,
    11  structure,  athletic  playing field, playground or land contained within

    12  the real property boundary line  of  a  public  or  private  elementary,
    13  secondary or vocational school, or similar educational institution where
    14  children are in daily attendance.
    15    3.  Any designated sex offender who violates any provision of subdivi-
    16  sion one of this section shall be guilty of a class E felony.
    17    § 2. This act shall take effect on the ninetieth day  after  it  shall
    18  have become a law.
