        Introduced  by  M.  of  A.  P. RIVERA  --  read once and referred to the
          Committee on Codes
 
        AN ACT to amend the penal law, in relation to the use  of  coercion  for
          the purpose of exposing a person's immigration status
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Subdivision 9 of  section  135.60  of  the  penal  law,  as
     2  amended  by chapter 426 of the laws of 2008, is amended and a new subdi-
     3  vision 10 is added to read as follows:
     4    9. Perform any other act which would not in itself materially  benefit
     5  the actor but which is calculated to harm another person materially with
     6  respect  to his or her health, safety, business, calling, career, finan-
     7  cial condition, reputation or personal relationships[.]; or
     8    10. Expose immigration status, regardless of the actor's knowledge  of
     9  such status.
    10    §  2.  Paragraph  (c)  of subdivision 2 of section 135.65 of the penal
    11  law, as amended by chapter 426 of the laws of 2008, is amended and a new
    12  paragraph (d) is added to read as follows:
    13    (c) Violate his or her duty as a public servant[.]; or

    14    (d) Expose his or her own immigration status.
    15    § 3. This act shall take effect on the first of November next succeed-
    16  ing the date on which it shall have become a law.
