        AN  ACT  to  amend the tax law, in relation to establishing a credit for
          customers of certain private  water  utilities;  and  in  relation  to
          requiring  a feasibility study relating to the Jericho Water District;
          and providing for the repeal of such provisions upon expiration there-
          of
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  606  of  the  tax law is amended by adding a new
     2  subsection (jjj) to read as follows:
     3    (jjj) Private water utility bill relief credit. (1) General. An  indi-
     4  vidual  taxpayer who is serviced by a private water utility, serving the
     5  towns of Hempstead and Oyster Bay located in the county of Nassau, shall
     6  be allowed a credit against the tax imposed by this article equal to the
     7  amount of any annual increase  of  such  taxpayer's  annual  water  bill
     8  directly  ascribable  to  an  increase  in  property  taxes paid by such
     9  private water utility.
    10    (2) Certification for credit allowance. The commissioner shall  deter-
    11  mine  the procedure for certification for the credit authorized pursuant
    12  to this subsection.
    13    § 2.   The public service commission,  in  conjunction  with  affected
    14  municipal  corporations located in the county of Nassau, shall conduct a
    15  feasibility study of the practicality of Jericho Water District, located
    16  in the town of Oyster Bay, supplying water to any current  customers  of
    17  American Water services. Such study shall examine the potential costs to
    18  the  Jericho  Water  District  of serving these customers, the potential
    19  costs to Jericho Water District of acquiring the rights to  serve  these
    20  customers,  the  potential new water rates as a result of such transfer,
    21  and any other information deemed  relevant  by  the  affected  municipal

     1  corporations. On or before December 31, 2019, the public service commis-
     2  sion  shall  submit  such  feasibility  study to the governor, temporary
     3  president of the senate, and speaker of the assembly.  For  purposes  of
     4  this  section,  "municipal  corporations" shall have the same meaning as
     5  such term is defined by section two of the general municipal law.
     6    § 3. This act shall take effect immediately; provided, however section
     7  one of this act shall apply to taxable years beginning on and after  the
     8  first  of January next succeeding the date on which it shall have become
     9  a law; provided, further, that this  act  shall  expire  and  be  deemed
    10  repealed December 31, 2022.
