AN ACT to authorize the department of health and the department of envi-
ronmental conservation to commission a study on the effects of long-
term, low radiation emissions from cellular phone antennas on human
beings, specifically the physical and mental development of adoles-
cents
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Public health study of the effects of long-term, low radi-
2 ation emissions from cellular phone antennas. 1. The state department of
3 health, in collaboration with the department of environmental conserva-
4 tion, shall immediately commission a study on the potential health risks
5 and effects of long-term, low-radiation emissions from cellular phone
6 towers, cellular phone antennas or base stations on human beings, with
7 particular attention to the potential health risks and adverse effects
8 on the mental and physical development of adolescents. The study shall
9 include a review of all available data relating to the increased volume
10 of cellular phone service carriers and of cellular phone towers, anten-
11 nas or base stations, and shall examine the potential health risks and
12 effects that such increases of cell phone service carriers and exposure
13 to cellular phone towers, cellular phone antennas and base stations may
14 have on human beings.
15 2. The commissioner of health and the commissioner of environmental
16 conservation, or their designees, shall:
17 a. Prepare and submit a report to the governor, the temporary presi-
18 dent of the senate and the speaker of the assembly, which includes all
19 data, research and studies conducted on cellular phone service carriers,
20 cellular phone towers and antennas, the effects of long-term human expo-

1 sure to low-radiation emissions from cellular phone antennas, and more
2 specifically, the potential health risks to the mental and physical
3 development of adolescents exposed to such emissions. Such report shall
4 be filed within six months of the effective date of this act, unless the
5 commissioner of health or the commissioner of environmental conservation
6 requests in writing, an extension of time; and
7 b. Send copies of such report to the office of the attorney general,
8 the New York city department of buildings, the state congressional
9 delegation, the United States senators from the state of New York and
10 the Federal Communications Commission.
11 3. All other departments and agencies of the state or subdivisions
12 thereof, and local governments shall, at the request of the commissioner
13 of health or the commissioner of environmental conservation, provide
14 expertise, assistance and data that will enable the commissioners to
15 carry out their powers and duties.
16 § 2. This act shall take effect immediately.
