AN ACT to amend the education law, in relation to limitation on expendi-
tures and authorizing expenditures under a contingency budget
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 1718 of the education law is amended by adding two
2 new subdivisions 3 and 4 to read as follows:
3 3. Notwithstanding any provisions of the law to the contrary, whenever
4 the legislature does not pass a budget by the third Tuesday in May, any
5 funds that a district receives in excess of funds approved by the voters
6 as a result of the legislature's subsequent passage of a budget, may be
7 spent on any ordinary contingent expenses. Such expenditures shall not
8 be included for purposes of calculating a district's authorized expenses
9 under a contingency budget.
10 4. Notwithstanding any provisions of the law to the contrary, whenever
11 the legislature approves a budget subsequent to the date of submittal to
12 the department for school report cards, districts may amend their budget
13 proposals to reflect any increased funding as a result of the legisla-
14 ture's subsequent passage of a budget.
15 § 2. This act shall take effect immediately.
