        AN  ACT  to amend the real property tax law, in relation to exemption of
          new multiple dwellings from local taxation; and in relation  to  addi-
          tional eligibility limitations on exemptions of new multiple dwellings
          from local taxation
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. The opening paragraph of item (A) of subparagraph  (iv)  of
     2  paragraph (a) of subdivision 2 of section 421-a of the real property tax
     3  law,  as  amended by chapter 349 of the laws of 2002, is amended to read
     4  as follows:
     5    Unless excluded by local law, in the city of New York, the benefits of
     6  this subparagraph shall be available in the borough of Manhattan for new
     7  multiple dwellings on tax lots now existing or hereafter  created  south
     8  of or adjacent to either side of one hundred tenth street which commence
     9  construction  after  July  first, nineteen hundred ninety-two and before
    10  December [thirty-first] twenty-eighth, two thousand [seven] ten only if:
    11    § 2. Subparagraph (ii) of paragraph (c) of subdivision  2  of  section
    12  421-a  of  the  real  property tax law, as amended by chapter 349 of the

    13  laws of 2002, is amended to read as follows:

     1    (ii) construction is commenced after January first,  nineteen  hundred
     2  seventy-five and before December [thirty-first] twenty-eighth, two thou-
     3  sand  [seven] ten provided, however, that such commencement period shall
     4  not apply to multiple dwellings eligible for benefits under subparagraph
     5  (iv) of paragraph (a) of this subdivision;
     6    §  3.  Section 421-a of the real property tax law is amended by adding
     7  nine new subdivisions 7, 8, 9, 10, 11, 13, 14 and 15 to read as follows:

     8    7. (a) For the purposes of this subdivision:
     9    (i) "affordable units" shall mean units which meet either of  the  two
    10  affordability  requirements  set forth in paragraph (b) of this subdivi-
    11  sion.
    12    (ii) "geographic exclusion areas" shall mean:
    13    (A) areas described in subdivision eleven of this section,
    14    (B) in the borough of Manhattan tax lots  now  existing  or  hereafter
    15  created south of or adjacent to either side of one hundred tenth street,
    16  and
    17    (C) areas made ineligible for the benefits of this section:
    18    (1)  as  set forth in section 11-245 of the administrative code of the
    19  city of New York on the effective date  of  this  subdivision,  notwith-

    20  standing any exceptions to ineligibility contained in such local law for
    21  certain types of projects in such areas,
    22    (2)  as  set  forth in local law number fifty-eight of the city of New
    23  York for the year two thousand six, notwithstanding  any  exceptions  to
    24  ineligibility  contained in such local law for certain types of projects
    25  in such areas and notwithstanding the effective date of such law, and
    26    (3) by local law after the effective date of this subdivision.
    27    (b) Notwithstanding any provision of this section or any local law  to
    28  the  contrary,  the  benefits of this section shall not be available for
    29  new multiple dwellings located in  a  geographic  exclusion  area  which

    30  commence  construction  after December twenty-eighth, two thousand seven
    31  unless they comply with the provisions of this subdivision for 40  years
    32  from  completion  of  construction  of  the  building receiving benefits
    33  pursuant to this section.
    34    (c)(i) Not less than twenty percent  of  the  units  in  the  multiple
    35  dwelling  must, upon the initial rental of the units and upon all subse-
    36  quent rentals of the units after a vacancy, be affordable to  and  occu-
    37  pied or available for occupancy by individuals or families whose incomes
    38  at the time of initial occupancy do not exceed sixty percent of the area
    39  median  incomes  adjusted for family size or (ii) if the construction of
    40  such building is carried out  with  substantial  assistance  of  grants,

    41  loans or subsidies from any federal, state or local agency or instrumen-
    42  tality  and  such  assistance  is provided pursuant to a program for the
    43  development of affordable housing which the local housing  agency  finds
    44  that such program provides opportunities for affordable housing compara-
    45  ble to the affordable requirements set forth in subparagraph (i) of this
    46  paragraph.
    47    (d) Unless preempted by federal requirements:
    48    (i)  all affordable units must have a comparable number of bedrooms as
    49  market rate units and a unit mix proportional to the market rate  units,
    50  or  at least fifty percent of the affordable units must have two or more
    51  bedrooms and no more than fifty percent of the remaining  units  can  be

    52  smaller than one bedroom; and
    53    (ii)  residents  of  the  community  board where the multiple dwelling
    54  which receives the benefits provided in this section  is  located  shall
    55  have priority for the purchase or rental of fifty percent of the afford-
    56  able units.

     1    (e)  Notwithstanding  any  provision of law to the contrary affordable
     2  units must  remain  as  rent  stabilized  units  for  forty  years  from
     3  completion  of construction provided that tenants holding a lease and in
     4  occupancy at the expiration of the rent stabilization period shall  have
     5  the right to remain as rent stabilized tenants for the duration of their
     6  occupancy.

     7    (f)  All affordable units must be situated onsite. For the purposes of
     8  this section, "onsite" shall mean that affordable units shall  be  situ-
     9  ated  within  the  building  or buildings for which benefits pursuant to
    10  this section are being granted.
    11    (g) The limitations on eligibility  for  benefits  contained  in  this
    12  subdivision  shall be in addition to those contained in this section and
    13  in any other law or regulation.
    14    8. (a) As used in this subdivision, the following terms shall have the
    15  following meanings:
    16    (i) "Building service employee" means  any  person  who  is  regularly
    17  employed  at a building who performs work in connection with the care or

    18  maintenance of such building. "Building service employee" includes,  but
    19  is  not  limited  to watchman, guard, doorman, building cleaner, porter,
    20  handyman, janitor, gardener, groundskeeper, elevator operator and start-
    21  er, and window cleaner.
    22    (ii) "Prevailing wage" means the wage determined by the fiscal officer
    23  to be prevailing for the various classes of building  service  employees
    24  in the locality pursuant to section two hundred thirty of the labor law.
    25    (b)  No  benefits  under  this  section  shall  be  conferred  for any
    26  construction commenced on or after December twenty-eighth, two  thousand
    27  seven  for  any  tax lots now existing or hereafter created except where
    28  the applicant agrees that all building service employees employed at the

    29  building, whether employed directly by the applicant or its  successors,
    30  or  through a property management company or a contractor, shall receive
    31  the applicable prevailing wage for the duration of  the  building's  tax
    32  exemption.
    33    (c)  The  limitations  contained  in paragraph (b) of this subdivision
    34  shall not be applicable to:
    35    (i) projects containing less than fifty dwelling units; or
    36    (ii) buildings where  the  local  housing  agency  certifies  that  at
    37  initial  occupancy  at  least  fifty  percent  of the dwelling units are
    38  affordable to individuals or families with a gross household  income  at
    39  or  below  one hundred twenty-five percent of the area median income and

    40  that such units will be subject to restrictions to insure that they will
    41  remain affordable for the entire period during which they receive  bene-
    42  fits under this section.
    43    (d)  The  local  hiousing agency shall prescribe appropriate sanctions
    44  for failure to comply with the provisions of this subdivison.
    45    (e) For purposes of paragraph (b) of  this  subdivision,  construction
    46  shall  be  deemed  to  have  commenced when excavation or alteration has
    47  begun in good faith on the basis of approved construction plans.
    48    (f) The limitations on eligibility  for  benefits  contained  in  this
    49  subdivision  shall be in addition to those contained in any other law or
    50  regulation.

    51    9. (a) As used in this subdivision, the following terms shall have the
    52  following meanings:
    53    (i) "Residential tax lot" shall mean a tax lot that contains  dwelling
    54  units.
    55    (ii)  "Non-residential  tax  lot"  shall  mean a tax lot that does not
    56  contain any dwelling units.

     1    (iii) "Annual limit" shall mean  sixty-five  thousand  dollars,  which
     2  amount shall be increased by three percent, compounded annually, on each
     3  taxable  status  date  following  the first anniversary of the effective
     4  date of this subdivision.
     5    (iv)  "Certificate  of  occupancy" shall mean the first certificate of

     6  occupancy covering all residential areas of the building on or  contain-
     7  ing a tax lot.
     8    (v) "Unit count" shall mean:
     9    (A)  in  the  case  of a residential tax lot that does not contain any
    10  commercial, community facility or accessory use  space,  the  number  of
    11  dwelling units in such tax lot, and
    12    (B)  in  the  case  of a residential tax lot that contains commercial,
    13  community facility or accessory use space, the number of dwelling  units
    14  in such tax lot plus one.
    15    (vi) "Exemption cap" shall mean the unit count multiplied by the annu-
    16  al limit.
    17    (b)  The  provisions  of this subdivision shall apply only to projects
    18  that commence construction on or after December twenty-eighth, two thou-

    19  sand seven.
    20    (c) The portion of the assessed valuation of any residential  tax  lot
    21  exempted  from  real  property  taxation  in  any  year pursuant to this
    22  section shall not exceed the exemption cap on or after the first taxable
    23  status date after the building on or containing such  tax  lot  receives
    24  its  certificate  of  occupancy,  unless,  it is located in a geographic
    25  exlusion area as defined  in  subdivision  seven  of  this  section  and
    26  complies  with  the  provisions of such subdivision.  The portion of the
    27  assessed valuation of all non-residential tax lots in the building on or
    28  containing such non-residential tax lots  exempted  from  real  property
    29  taxation in any year pursuant to this section shall not exceed a cumula-

    30  tive  total  equal  to  the  annual  limit on or after the first taxable
    31  status date after the building on or containing such non-residential tax
    32  lots receives its certificate of occupancy.   A dwelling unkit  that  is
    33  located in two or more tax lots shall be ineligible to recieve any bene-
    34  fits under this section.
    35    10.  (a) The local housing agency shall implement procedures to insure
    36  that affordable units created pursuant to this section, or  units  which
    37  are  required  to  be occupied by persons or families who meet specified
    38  income limits pursuant to the provisions of a local law enacted pursuant
    39  to this section, continue to be affordable as required by the provisions
    40  of this section or such local law, and that units made subject  to  rent

    41  stabilization  remain  subject  thereto as required by the provisions of
    42  this section. Such procedures shall include but shall not be limited  to
    43  the following:
    44    (i)  all  rent  stabilization registrations required to be filed on or
    45  after January first, two thousand  eight  shall  contain  a  designation
    46  which  identifies  all  units that are subject to the provisions of this
    47  section as "421-a units" and specifically  identifies  affordable  units
    48  created  pursuant  to  this  section  and units which are required to be
    49  occupied by persons or families who meet specified income limits  pursu-
    50  ant to the provisions of a local law enacted pursuant to this section as
    51  "421-a  affordable  units"  and  shall  contain  an  explanation  of the

    52  requirements that apply to all such units;
    53    (ii) the division of housing and community renewal shall  monitor  and
    54  enforce compliance with the filing requirements of this section;
    55    (iii) the local housing agency shall create a report which, at a mini-
    56  mum,  contains  the  following  information  for  every  building  which

     1  receives benefits pursuant to this section:  address,  commencement  and
     2  termination  date  of  the  benefits, total number of residential units,
     3  number of "421-a units" and number of "421-a affordable  units",  apart-
     4  ment  number or other designation of such units and the rent for each of
     5  such units. The local housing agency with the cooperation of  the  divi-

     6  sion  of  housing  and community renewal shall maintain, and update such
     7  report no less than  annually,  with  information  secured  from  annual
     8  registrations.  Such reports shall be available for public inspection in
     9  a  form  that  assigns  a unique designation to each unit other than its
    10  actual apartment number to maintain the privacy of such information; and
    11    (iv) the local housing agency shall monitor any change in such  infor-
    12  mation,  shall  investigate any such changes which indicate a failure to
    13  comply with the provisions of this section, and shall  take  appropriate
    14  action based on its findings.
    15    (b)  Failure  to  comply  with  the  provisions  of this section which

    16  require the creation and maintenance of  affordable  units  pursuant  to
    17  this  section,  or units which are required to be occupied by persons or
    18  families who meet specified income limits pursuant to the provisions  of
    19  a  local  law  enacted  pursuant to this section, at any time during the
    20  duration of the building's tax exemption shall result in  revocation  of
    21  any  benefits  under this section for the period of such non-compliance.
    22  If an on-going pattern of non-compliance is found to exist,  such  bene-
    23  fits may be revoked from their inception.
    24    (c)  The provisions of this subdivision relating to enforcement of the
    25  provisions of this section shall be in addition to any other  provisions
    26  contained in this section or any other law.

    27    11. Additional geographic exclusion areas:
    28    (a)  Any  tax lots now existing or hereafter created which are located
    29  entirely within the geographic area in the borough of  Brooklyn  bounded
    30  and described as follows:
    31    (i)  In the County of Kings, Beginning at a point where Warwick Street
    32  meets Belmont Avenue,  thence  westerly  along  said  avenue  to  Jerome
    33  Street,  thence  southerly  along  said  street to Sutter Avenue, thence
    34  westerly on said avenue to Barbey Street, thence  northerly  along  said
    35  street  to  Belmont Avenue, thence westerly on said avenue to New Jersey
    36  Avenue, thence southerly on said avenue to Sutter Avenue, thence wester-
    37  ly on said avenue to  Pennsylvania  Avenue,  thence  northerly  on  said

    38  avenue  to  Belmont  Avenue, thence westerly on said avenue to Sheffield
    39  Avenue, thence southerly on said avenue to Sutter Avenue, thence wester-

    55    12. An agreement with the local housing agency to create  or  substan-

    56  tially  rehabilitate  offsite  housing units affordable to households of

     1  low and moderate income, shall remain in  full  force  and  effect.  The
     2  housing  units  developed  pursuant  to such agreement shall continue to
     3  make a building or buildings located in geographic  exclusion  areas  as
     4  defined  in  this  subdivision  eligible to receive benefits pursuant to
     5  this section notwithstanding the provisions of subdivision seven or nine
     6  of this section or any exemption cap provided in local law provided that
     7  the agreement with the local housing agency was entered  into  prior  to
     8  December  twenty-eighth, two thousand six and construction of the build-

     9  ing receiving benefits pursuant to  this  section  is  commenced  on  or
    10  before June thirtieth, two thousand nine.
    11    13.  A multi-phase project that includes at least 2,500 dwelling units
    12  and  (i) is being implemented pursuant to a General Project Plan adopted
    13  by the New York State Urban  Development  Corporation  and  approved  by
    14  Public Authorities Control Board or is otherwise set forth in agreements
    15  with  the New York State Urban Development Corporation and (ii) includes
    16  a development over a number of city blocks, shall be eligible for  bene-
    17  fits  pursuant to this section notwithstanding paragraph (e) of subdivi-
    18  sion 7 of this section if in the aggregate twenty percent of  the  units

    19  in  such  development  are  affordable  to and occupied or available for
    20  occupancy by individuals or  families  whose  incomes  at  the  time  of
    21  initial  occupancy  do  not exceed 60 percent of the area median incomes
    22  adjusted for family size and the rent for such  units  does  not  exceed
    23  thirty percent of eighty percent of the area median incomes adjusted for
    24  family size.
    25    14.  The  provisions  of  subdivisions  seven and nine of this section
    26  shall not apply to (1) multiple dwellings  which  commence  construction
    27  prior  to  July  first, two thousand eight; or (2) where commencement of
    28  construction is delayed as a result of litigation relating to a contract
    29  for the purchase of real property entered into prior to  December  twen-

    30  ty-eight,  two thousand six and in which a judgment was entered prior to
    31  the effective  date  of  this  subdivision  provided  that  construction
    32  commences  within  a reasonable time after final resolution of the liti-
    33  gation; or (3) where benefits pursuant to this section are sought for  a
    34  building   located   on   a  site  requiring  environmental  remediation
    35  construction and a certificate of completion pursuant to section 27-1419
    36  of the environmental conservation law has  been  issued  prior  to  July
    37  first, two thousand eight, provided that construction is completed with-
    38  out undue delay.
    39    15.  Paragraphs  2 through 4 of subdivision a of section 11-245 of the
    40  administrative code of the city of New York, subdivisions b-1 and b-2 of

    41  section 11-245 of the administrative code of the city of  New  York  and
    42  Part  l  of  subchapter 2 of chapter 2 of title 11 of the administrative
    43  code of the city of New York, as added by local law No.  58 of the  City
    44  of  New York for the year 2006 shall not apply to (1) multiple dwellings
    45  which commence  construction  prior  to  July  1,  2008;  or  (2)  where
    46  commencement of construction is delayed as a result of litigation relat-
    47  ing  to  a contract for the purchase of real property entered into prior
    48  to December 28, 2006 and in which a judgment was entered  prior  to  the
    49  effective  date of this subdivision provided that construction commences
    50  within a reasonable time after final resolution of  the  litigation;  or

    51  (3)  where  benefits  pursuant to this section are sought for a building
    52  located on a site requiring environmental remediation construction and a
    53  certificate of completion pursuant to section 27-1419  of  the  environ-
    54  mental  conservation law has been issued prior to July 1, 2008, provided
    55  that construction is completed without undue delay.

     1    § 4. Subparagraph (iii) of paragraph (a) of subdivision 2  of  section
     2  421-a of the real property tax law is amended by adding a new clause (E)
     3  to read as follows:
     4    (E)  A  new  multiple  dwelling that is situated in (1) a neighborhood
     5  preservation program area as determined by  the  department  of  housing

     6  preservation  and development as of June first, nineteen hundred eighty-
     7  five, (2) a neighborhood preservation area as determined by the New York
     8  city planning commission as of June first, nineteen hundred eighty-five,
     9  (3) an area that was eligible for mortgage  insurance  provided  by  the
    10  rehabilitation  mortgage insurance corporation as of May first, nineteen
    11  hundred ninety-two, or (4) an area receiving funding for a  neighborhood
    12  preservation  project  pursuant  to the neighborhood reinvestment corpo-
    13  ration act (42 U.S.C. §§ 8101  et  seq.)  as  of  June  first,  nineteen
    14  hundred  eighty-five,  shall  not be eligible for the benefits available
    15  pursuant to this subparagraph unless it complies with the provisions  of

    16  subdivision seven of this section.
    17    § 5. Paragraph (i) of subdivision 2 of section 421-a of the real prop-
    18  erty  tax law, as amended by chapter 832 of the laws of 1992, is amended
    19  to read as follows:
    20    (i) Authority of city to enact local law. Except as  otherwise  speci-
    21  fied  in  this  section,  a city to which this section is applicable may
    22  enact a local law to restrict, limit or condition the eligibility, scope
    23  or amount of the benefits under this section in any manner provided that
    24  such local law may not grant benefits  beyond  those  provided  in  this
    25  section and provided further that in the city of New York such local law
    26  shall  not  take  effect  sooner  than  one  year  after  it is enacted.
    27  Notwithstanding the foregoing, the provisions of any local law shall not

    28  be inconsistent with subdivisions seven through fifteen of this section.
    29    § 6. This act shall take effect immediately; provided,  however,  this
    30  act  shall  not affect any benefits conferred prior to December 28, 2007
    31  except as specifically provided in this act; the limitations  on  eligi-
    32  bility  for benefits contained in this act shall be in addition to those
    33  contained in any other law including any local law enacted  pursuant  to
    34  section 421-a of the real property tax law and the limitations on eligi-
    35  bility  for  benefits contained in this act shall not apply to a covered
    36  project as defined in subparagraph (i) of paragraph (a) of subdivision 6
    37  of section 421-a of the real property tax law.
