        AN ACT to amend the education law and the  public  authorities  law,  in
          relation to reducing state aid for certain independent institutions of

          higher  learning;  to  provide  for  transfer  and disbursement to the
          colleges and universities of the state university of New York and  the
          city  university  of  New  York  of  the  moneys  remaining  after the
          reduction and elimination of state aid to certain  independent  insti-
          tutions  of  higher  learning; and to repeal certain provisions of the
          education law relating to state aid  for  certain  independent  insti-
          tutions of higher learning
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 3 of section 6401  of  the  education  law,  as
     2  amended  by  chapter  507  of  the  laws  of 2008, is amended to read as
     3  follows:
     4    3. Degree awards. The amount of  such  annual  apportionment  to  each

     5  institution  meeting the requirements of subdivision two of this section
     6  shall be computed by multiplying [by not to exceed six hundred dollars]
     7    (a) the number of earned associate degrees[,]  by  an  amount  not  to
     8  exceed [one thousand five hundred dollars]:
     9    (i) for each annual period commencing on or after July first, nineteen
    10  hundred  seventy-six  and  before  July  first, two thousand twelve, six
    11  hundred dollars,
    12    (ii) for the annual period commencing  on  July  first,  two  thousand
    13  twelve, four hundred eighty dollars,
    14    (iii)  for  the  annual  period commencing on July first, two thousand
    15  thirteen, three hundred sixty dollars,

    16    (iv) for the annual period commencing  on  July  first,  two  thousand
    17  fourteen, two hundred forty dollars, and
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    (v)  for  the  annual  period  commencing  on July first, two thousand
     2  fifteen, one hundred twenty dollars;
     3    (b)  the  number  of  earned bachelor's degrees[,] by an amount not to
     4  exceed [nine hundred fifty dollars]:
     5    (i) for each annual period commencing on or after July first, nineteen

     6  hundred seventy-six and before July  first,  two  thousand  twelve,  one
     7  thousand five hundred dollars,
     8    (ii)  for  the  annual  period  commencing on July first, two thousand
     9  twelve, one thousand two hundred dollars,
    10    (iii) for the annual period commencing on  July  first,  two  thousand
    11  thirteen, nine hundred dollars,
    12    (iv)  for  the  annual  period  commencing on July first, two thousand
    13  fourteen, six hundred dollars, and
    14    (v) for the annual period  commencing  on  July  first,  two  thousand
    15  fifteen, three hundred dollars;
    16    (c)  the  number of earned master's degrees[, and] by an amount not to
    17  exceed [four thousand five hundred fifty dollars]:

    18    (i) for each annual period commencing on or after July first, nineteen
    19  hundred seventy-six and before July first,  two  thousand  twelve,  nine
    20  hundred fifty dollars,
    21    (ii)  for  the  annual  period  commencing on July first, two thousand
    22  twelve, seven hundred sixty dollars,
    23    (iii) for the annual period commencing on  July  first,  two  thousand
    24  thirteen, five hundred seventy dollars,
    25    (iv)  for  the  annual  period  commencing on July first, two thousand
    26  fourteen, three hundred eighty dollars, and
    27    (v) for the annual period  commencing  on  July  first,  two  thousand
    28  fifteen, one hundred ninety dollars; and
    29    (d)  the  number  of  earned  doctorate degrees[,] by an amount not to

    30  exceed:
    31    (i) for each annual period commencing on or after July first, nineteen
    32  hundred seventy-six and before July first,  two  thousand  twelve,  four
    33  thousand five hundred fifty dollars,
    34    (ii)  for  the  annual  period  commencing on July first, two thousand
    35  twelve, three thousand six hundred forty dollars,
    36    (iii) for the annual period commencing on  July  first,  two  thousand
    37  thirteen, two thousand seven hundred thirty dollars,
    38    (iv)  for  the  annual  period  commencing on July first, two thousand
    39  fourteen, one thousand eight hundred twenty dollars, and
    40    (v) for the annual period  commencing  on  July  first,  two  thousand
    41  fifteen, nine hundred ten dollars;

    42  conferred  by  such  institution  during  the  twelve-month  period next
    43  preceding the annual  period  for  which  such  apportionment  is  made,
    44  provided  that  there  shall  be  excluded from any such computation the
    45  number of degrees earned by students with  respect  to  whom  state  aid
    46  other  than  that  established  by  this  section  or section sixty-four
    47  hundred one-a of this article is granted directly  to  the  institution,
    48  and provided further that, except as otherwise provided in this subdivi-
    49  sion,  the  amount  apportioned for an associate degree shall be awarded
    50  only to two year institutions qualifying under subdivision two  of  this
    51  section.  The  regents  shall  promulgate rules defining and classifying
    52  professional degrees for the purposes of  this  section.    Institutions
    53  qualifying  for state aid pursuant to the provisions of paragraph (b) of

    54  subdivision two of this section shall, for purposes of this subdivision,
    55  be deemed to be the institutions which confer degrees.  For purposes  of
    56  this subdivision, a two-year institution which has received authority to

     1  confer  bachelor  degrees  shall  continue  to  be considered a two-year
     2  institution until such time as it has actually begun to confer the bach-
     3  elor's degree. Thereafter, notwithstanding any other provision of law to
     4  the  contrary,  an institution which was formerly a two-year institution
     5  for the purposes of this section and which was granted authority by  the
     6  regents  to  confer  bachelor  degrees,  (a)  such authority having been
     7  granted after the first day of June, nineteen hundred ninety-three,  but
     8  before the first day of July, nineteen hundred ninety-three, or (b) such

     9  authority  having  been granted after the first day of May, two thousand
    10  five, but before the first day of June, two thousand five, may elect  to
    11  continue  to  receive  awards  for earned associate degrees. Should such
    12  institution so elect, it shall not be eligible during the time  of  such
    13  election to receive awards for earned bachelor's degrees.
    14    § 2. Section 6401 of the education law is REPEALED.
    15    § 3. Subdivision 3 of section 6402 of the education law is REPEALED.
    16    §  4.  Subdivision 1 of section 6431 of the education law, as added by
    17  chapter 597 of the laws of 2003, is amended to read as follows:
    18    1. The president or chief administrative  officer  of  each  college[,
    19  except  those independent colleges ineligible to receive state aid under
    20  section sixty-four hundred one of this title,] shall appoint an advisory

    21  committee on campus security.
    22    § 5. Paragraph (f) of subdivision 2 of section 1680-j  of  the  public
    23  authorities  law,  as added by section 1 of part MM of chapter 59 of the
    24  laws of 2004, is amended to read as follows:
    25    (f) "Independent college" shall mean each  independent  not-for-profit
    26  institution  of  higher  education[,  as  defined  in subdivision two of
    27  section sixty-four hundred one of the education law].
    28    § 6. Notwithstanding any provision of law to the  contrary,  for  each
    29  annual period commencing on or after July 1, 2012, there shall be trans-
    30  ferred  for  disbursement and expenditure by the state university of New
    31  York and the city university of New York,  the  difference  between  the
    32  moneys  expended  pursuant  to section 6401 of the education law for the

    33  period July 1, 2011 through June 30, 2012 and the moneys expended pursu-
    34  ant to such section for each annual period thereafter.
    35    The monies directed to be transferred pursuant to this  section  shall
    36  be allocated among the colleges and universities of the state university
    37  of  New York and the city university of New York on the basis of the New
    38  York state student enrollment of each such college  or  university.  All
    39  moneys  transferred  pursuant  to this section shall be expended for the
    40  purpose of facilitating student retention and success in  such  colleges
    41  and universities.
    42    §  7.  This act shall take effect immediately, provided, that sections
    43  two, three, four and five of this act shall take effect July 1, 2016.
