AN ACT to amend the agriculture and markets law, in relation to requir-
ing an authorized agent of the department of agriculture and markets
to be present at all disposal rendering plants during all hours of
operation
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 96-z-8 of the agriculture and markets law, as added
2 by chapter 391 of the laws of 1968, is amended to read as follows:
3 § 96-z-8. Access to premises; records. 1. The commissioner may inspect
4 as often as he or she deems necessary, each disposal plant or vehicle
5 licensed under the provisions of this article. For the purpose of making
6 such inspection, the commissioner and his or her authorized agents shall
7 have free access to all disposal plants licensed [hereunder] under this
8 article and to all premises where vehicles used in a transportation
9 service are located. Licensees shall maintain such records as the
10 commissioner may require pertaining to the origin, movement, storage,
11 distribution or other disposition of inedible meat and such records
12 shall be open to inspection by the commissioner or his or her authorized
13 agents at any time during normal working hours.
14 2. The commissioner shall require a department inspector to be present
15 at all disposal plants during all hours of operation of such plant for
16 the purposes of enforcing the provisions of this article and making
17 daily inspections. For the purposes of this subdivision a "department
18 inspector" shall mean an authorized government official having the
19 jurisdiction to enforce the provisions of this article.
20 § 2. This act shall take effect on the thirtieth day after it shall
21 have become a law.
