        Introduced  by M. of A. PRETLOW -- read once and referred to the Commit-
          tee on Racing and Wagering
 
        AN ACT to amend the tax law, in relation  to  prohibiting  the  removal,
          confiscation  or  destruction  of lottery tickets prior to such game's
          expiration date
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision a of section 1609 of the tax law, as amended by
     2  chapter 254 of the laws of 2008, is amended to read as follows:
     3    a.  1.  Lottery  tickets  shall  be  in  such form as the division may
     4  prescribe. No ticket shall be sold at a price greater than that fixed by
     5  the division nor shall a sale  be  made  by  any  person  other  than  a
     6  licensed  lottery sales agent, and a violation of these provisions shall
     7  be a misdemeanor, but this shall not be deemed  to  prevent  any  person
     8  from giving lottery tickets as premiums to customers, employees or other
     9  dealing with him.
    10    2.  The  division  shall not remove, confiscate or destroy any lottery
    11  ticket from any vendor prior to such game's expiration date.
    12    § 2. This act shall take effect immediately.
