        Introduced  by M. of A. CLARK -- read once and referred to the Committee

        AN ACT to amend the social services  law,  in  relation  to  residential
          programs for adults with traumatic brain injuries
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The social services law is amended by adding a new  section
     2  461-n to read as follows:
     3    §  461-n.  Residential  care  programs for adults with traumatic brain
     4  injuries. Any residential adult care  facility  serving  residents  with
     5  traumatic brain injury must hold a national certification by the academy
     6  of  certified  brain  injury  specialists  as  a  certified brain injury
     7  specialist (CBIS), or hold a current professional license  or  employ  a
     8  resident  manager  who  holds a current professional license as a physi-
     9  cian, nurse  practitioner,  registered  nurse,  licensed  rehabilitation
    10  professional,  certified  brain  injury  specialist  (CBIS)  or licensed
    11  mental health professional who is trained and experienced  in  the  care
    12  and rehabilitation of residents with traumatic brain injury.
    13    §  2.  This  act shall take effect on the ninetieth day after it shall
    14  have become a law, provided, however, that  effective  immediately,  the
    15  addition,  amendment  and/or  repeal of any rule or regulation necessary
    16  for the implementation of this act on its effective date are  authorized
    17  to be made on or before such effective date.
