        AN ACT to amend the election law,  in  relation  to  the  furnishing  of
          gratuities immediately prior to an election
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1. The election law is amended by adding a new section  17-138
     2  to read as follows:
     3    §  17-138.  Furnishing  gratuities prior to an election. 1. No person,
     4  candidate, political party or committee acting on behalf of any campaign
     5  for election to any public office or party position shall, within  twen-
     6  ty-four hours prior to the opening of the polls for the election to such
     7  public  office or party position, give, offer to give or promise to give
     8  any thing of value to another person.
     9    2. The provisions of subdivision one of this section shall  not  apply
    10  to  the distribution of pamphlets, circulars, flyers, brochures, letter-
    11  heads or other printed material on behalf of any candidate.

    12    3. Any person who violates the provisions of subdivision one  of  this
    13  section shall be guilty of a class A misdemeanor.
    14    §  2.  This  act shall take effect on the thirtieth day after it shall
    15  have become a law.
