        AN ACT to amend the executive law, in relation to requiring the  instal-
          lation of operable portable fire extinguishers in certain R-3 residen-
          tial occupancies
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Section 378 of the executive law is amended by adding a new
     2  subdivision 5-d to read as follows:
     3    5-d. Standards for fire extinguishers requiring that every  R-3  resi-
     4  dential  occupancy  in this state, constructed or offered for sale after
     5  the effective date of this subdivision, shall have installed an operable
     6  portable fire extinguisher of such manufacture, design and standards  as
     7  are  established  by  the  council. For the purpose of this subdivision,
     8  "R-3 residential occupancy" shall have the same meaning  as  defined  in
     9  the New York state uniform fire prevention and building code.

    10    § 2. This act shall take effect on the one hundred twentieth day after
    11  it  shall have become a law. Effective immediately, the addition, amend-
    12  ment and/or repeal of any rules or regulations by the secretary of state
    13  necessary for the implementation of section  one  of  this  act  on  its
    14  effective  date  is  authorized  to  be made on or before such effective
    15  date.
