AN ACT to amend the general municipal law, in relation to allowing the
governing body of Westchester county to appoint a member of the West-
chester county industrial development agency
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 923-a of the general municipal law, as amended by
2 chapter 564 of the laws of 1983, is amended to read as follows:
3 § 923-a. County of Westchester industrial development agency. For the
4 benefit of the county of Westchester and the inhabitants thereof, an
5 industrial development agency, to be known as the COUNTY OF WESTCHESTER
6 INDUSTRIAL DEVELOPMENT AGENCY, is hereby established for the accomplish-
7 ment of any or all of the purposes specified in title one of this arti-
8 cle [eighteen-A of this chapter]. It shall constitute a body corporate
9 and politic, and be perpetual in duration. It shall have the powers and
10 duties now or hereafter conferred by title one of this article [eigh-
11 teen-A of this chapter] upon industrial development agencies and
12 provided that the exercise of the powers by such agency with respect to
13 the acquisition of real property whether by purchase, condemnation or
14 otherwise, shall be limited to the corporate limits of the county of
15 Westchester and such agency shall take into consideration the local
16 zoning and planning regulations as well as regional and local land use
17 plans. The agency shall not use its funds to commence any project
18 unless (i) at least thirty days' prior notice of such project shall have
19 been given to each local municipality in which a part or parts of the
20 project is, or is to be, located and (ii) no objection, by resolution of
21 the governing body of such municipality, shall have been made and deliv-
22 ered to the agency within such thirty days. Notwithstanding the
23 provisions of the next preceding sentence, in the case of a project

1 which is, or is to be, located within a village within the county of
2 Westchester, notice to such village shall be sufficient as to any part
3 or parts of the project within the village and no other notice shall be
4 required to be given to any other municipality in which such village is
5 located with respect thereto. It shall be organized in a manner
6 prescribed by and be subject to the provisions of title one of this
7 article [eighteen-A of this chapter] and shall consist of [seven] eight
8 members. Its members shall be appointed by the chief executive officer
9 of the county of Westchester, subject to confirmation by its governing
10 body, except that one member shall be appointed by the presiding officer
11 of the governing body of the county of Westchester, subject to confirma-
12 tion by its governing body, who may be a member of such governing body.
13 The member appointed by the presiding officer shall be a non-voting
14 member. The agency, its members, officers and employees, and its oper-
15 ations and activities shall in all respects be governed by the
16 provisions of title one of this article [eighteen-A of this chapter].
17 § 2. This act shall take effect immediately.
