        AN ACT to amend the agriculture and markets law, in relation to  licens-
          ing of dogs that are redeemed or adopted from shelters or pounds
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Paragraph (b) of subdivision 1 of section 109 of the  agri-
     2  culture and markets law, as amended by section 4 of part T of chapter 59
     3  of the laws of 2010, is amended to read as follows:
     4    (b)  Application  for  a dog license shall be made to the clerk of the
     5  town, city, or county or, in the counties  of  Nassau  and  Westchester,
     6  incorporated  village  in  which  the  dog is harbored or to the village
     7  clerk of those villages in the county of Rockland with a  population  of
     8  fifteen  thousand  or  more  which  have  elected to accept applications
     9  pursuant to the provisions of this paragraph or to the village clerk  of
    10  the  village  of  Newark in the county of Wayne upon the election of the

    11  village  of  Newark  pursuant  to  the  provisions  of  this  paragraph.
    12  Provided,  however,  that in the counties of Nassau and Westchester, the
    13  board of trustees of any incorporated village may by resolution  provide
    14  that  applications  for  licenses shall no longer be made to the village
    15  clerk, but to the clerk of the town in which the  village  is  situated.
    16  Provided  further, however, that in the county of Rockland, the board of
    17  trustees of any incorporated village with a population of fifteen  thou-
    18  sand  or  more  may  by resolution provide that application for licenses
    19  shall be made to the village clerk. Provided further, however,  that  in
    20  the  county of Wayne, the board of trustees of the village of Newark may
    21  by resolution provide that application for licenses shall be made to the
    22  village clerk. The governing body of any town or city or, in  the  coun-

    23  ties of Nassau and Westchester, incorporated village or in the county of
    24  Rockland,  those  villages with a population of fifteen thousand or more
    25  which have so elected to accept applications or in the county of  Wayne,

     1  the  village of Newark if such village has so elected to accept applica-
     2  tions may, on resolution of such body, authorize that  such  application
     3  be made to one or more named dog control officers of any such town, city
     4  or  village.  The  issuance  of any license by any such officer shall be
     5  under the control and supervision of the clerk. In the case of a  seized

     6  dog  being  redeemed or a dog being otherwise obtained or adopted from a
     7  county animal shelter or pound, such application  may  be  made  to  the
     8  county dog control officer in charge of such facility or to the clerk of
     9  the  county in which such shelter or pound is situated. In the case of a
    10  dog being redeemed or a dog being adopted from a shelter or pound estab-
    11  lished, maintained or contracted for, pursuant to  section  one  hundred
    12  fourteen of this article, such application may be made to the manager of
    13  such  facility, provided such manager has been authorized by the munici-
    14  pality  in  which  the  prospective  owner  resides   to   accept   such
    15  application,  or  to  the  clerk  of the county in which such shelter or
    16  pound is situated.  Such authorization shall be requested by the govern-

    17  ing body of the pound or shelter and the  granting  or  denial  of  such
    18  authorization  shall  be  in the discretion of the municipality in which
    19  the prospective owner resides.
    20    § 2. This act shall take effect immediately.
