AN ACT to amend the education law, in relation to adding a regional cost
of living factor into any category of aid to school districts in which
a statewide formula is used
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 3602-g
2 to read as follows:
3 § 3602-g. Regional cost factor. 1. In addition to any other apportion-
4 ment, for aid payable in the two thousand nine -- two thousand ten
5 school year and thereafter, a school district shall be eligible for an
6 apportionment under the provisions of this section to account for the
7 higher cost of providing a public education in certain areas of the
8 state. A school district's apportionment under this section shall be
9 computed by multiplying the appropriate regional cost factor by the
10 total amount of formula aids payable to such district under subdivisions
11 nine, twelve, and thirteen, paragraphs d and f of subdivision fourteen,
12 and subdivision sixteen, of section thirty-six hundred two of this arti-
13 cle, subdivisions four, six, and seven of section seven hundred one of
14 this chapter, subdivision four of section seven hundred eleven of this
15 chapter, section seven hundred fifty-one of this chapter, and section
16 thirty-six hundred two-e of this article in the current year.
17 2. The commissioner, in consultation with the department of labor,
18 shall annually compute the regional cost factors for the various regions
19 of the state. In making such computations, the commissioner shall
20 consider, at a minimum, the cost to school districts of providing for
21 employees' salaries, students' transportation, and the acquisition of
22 various goods and services; provided, however, that in no case shall the
23 regional cost factor exceed five hundredths.

1 3. For the purposes of this section, a school district shall be deemed
2 to be situated in the region in which the majority of its students
3 reside.
4 § 2. This act shall take effect immediately.
