AN ACT to amend the criminal procedure law, in relation to designating
sheriffs, under-sheriffs and deputy sheriffs of the city of New York
as police officers
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph (b) of subdivision 34 of section 1.20 of the
2 criminal procedure law is amended to read as follows:
3 (b) Sheriffs, under-sheriffs and deputy sheriffs [of counties outside
4 of New York City];
5 § 2. Paragraph (b) of subdivision 34 of section 1.20 of the criminal
6 procedure law, as amended by section 13 of part BBB of chapter 59 of the
7 laws of 2021, is amended to read as follows:
8 (b) Sheriffs, under-sheriffs and deputy sheriffs [of counties outside
9 of New York City where such department is certified in accordance with
10 paragraph (d) of subdivision one of section eight hundred forty-six-h of
11 the executive law];
12 § 3. Subdivision 2 of section 2.10 of the criminal procedure law, as
13 amended by chapter 969 of the laws of 1983, is amended to read as
14 follows:
15 2. [The sheriff, undersheriff and deputy sheriffs of New York city and
16 sworn] Sworn officers of the Westchester county department of public
17 safety services appointed after January thirty-first, nineteen hundred
18 eighty-three to the title of public safety officer and who perform the
19 functions previously performed by a Westchester county deputy sheriff on
20 or prior to such date.
21 § 4. This act shall take effect immediately; provided, however, that
22 section two of this act shall take effect on the same date and in the
23 same manner as section 13 of part BBB of chapter 59 of the laws of 2021,
24 takes effect.
