AN ACT to amend the education law, in relation to increasing the amount
of the salary paid to any career and technical education teacher,
supervisor or other employee of a program of the board of cooperative
educational services that is considered to be an approved expense for
purposes of state allocation
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph b of subdivision 5 of section 1950 of the educa-
2 tion law, as amended by chapter 296 of the laws of 2016, is amended to
3 read as follows:
4 b. The cost of services herein referred to shall be the amount allo-
5 cated to each component school district by the board of cooperative
6 educational services to defray expenses of such board, including
7 approved expenses from the testing of potable water systems of occupied
8 school buildings under the board's jurisdiction as required pursuant to
9 section eleven hundred ten of the public health law, except that that
10 part of the salary paid any teacher, supervisor or other employee of the
11 board of cooperative educational services which is in excess of thirty
12 thousand dollars shall not be such an approved expense, and except also
13 that administrative and clerical expenses shall not exceed ten percent
14 of the total expenses for purposes of this computation. Provided howev-
15 er, that beginning in the two thousand nineteen--two thousand twenty
16 school year, that part of the salary paid to any career and technical
17 education teacher, supervisor or other employee of a program of the
18 board of cooperative educational services which is in excess of thirty-
19 six thousand dollars shall not be such an approved expense; beginning in
20 the two thousand twenty--two thousand twenty-one school year, that part
21 of the salary paid to any career and technical education teacher, super-
22 visor or other employee of a board of cooperative educational services

1 which is in excess of forty-two thousand dollars shall not be such an
2 approved expense; beginning in the two thousand twenty-one--two thousand
3 twenty-two school year, that part of the salary paid any career and
4 technical education teacher, supervisor or other employee of the board
5 of cooperative educational services which is in excess of forty-eight
6 thousand dollars shall not be such an approved expense; beginning in the
7 two thousand twenty-two--two thousand twenty-three school year, that
8 part of the salary paid any career and technical education teacher,
9 supervisor or other employee of the board of cooperative educational
10 services which is in excess of fifty-four thousand dollars shall not be
11 such an approved expense and provided further beginning in the two thou-
12 sand twenty-three--two thousand twenty-four school year and thereafter,
13 the actual salary or the average statewide salary as established by the
14 commissioner, whichever is less, shall be paid for any career and tech-
15 nical education teacher, supervisor or other employee of the board of
16 cooperative educational services; provided further that beginning in the
17 two thousand nineteen--two thousand twenty school year and every year
18 thereafter, the cost of services provided by any career and technical
19 education teacher, supervisor or other employee of the board of cooper-
20 ative educational services that is certified by the commissioner to be
21 of sufficient rigor to meet national standards shall be one hundred
22 percent of such salary or the average statewide salary, whichever is
23 less as determined by the commissioner. Any gifts, donations or interest
24 earned by the board of cooperative educational services or on behalf of
25 the board of cooperative educational services by the dormitory authority
26 or any other source shall not be deducted in determining the cost of
27 services allocated to each component school district. Any payments made
28 to a component school district by the board of cooperative educational
29 services pursuant to subdivision eleven of section six-p of the general
30 municipal law attributable to an approved cost of service computed
31 pursuant to this subdivision shall be deducted from the cost of services
32 allocated to such component school district. The expense of transporta-
33 tion provided by the board of cooperative educational services pursuant
34 to paragraph q of subdivision four of this section shall be eligible for
35 aid apportioned pursuant to subdivision seven of section thirty-six
36 hundred two of this chapter and no board of cooperative educational
37 services transportation expense shall be an approved cost of services
38 for the computation of aid under this subdivision. Transportation
39 expense pursuant to paragraph q of subdivision four of this section
40 shall be included in the computation of the ten percent limitation on
41 administrative and clerical expenses.
42 § 2. This act shall take effect immediately.
