        AN  ACT  to amend the general obligations law, in relation to the use of
          protective headgear at ski areas
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 

     1    Section  1.  The  general  obligations  law is amended by adding a new
     2  section 18-105-a to read as follows:
     3    § 18-105-a. Use of protective headgear at ski areas. 1. No participant
     4  shall engage in ski area activity unless such participant is  wearing  a
     5  helmet meeting the appropriate standards of the American National Stand-
     6  ards  Institute or the Snell-Memorial Foundation's standards for protec-
     7  tive headgear. For the purpose of  this  subdivision  wearing  a  helmet
     8  means  having  a helmet of good fit fastened securely upon the head with
     9  helmet straps.
    10    2. Any participant who violates the provisions of subdivision  one  of
    11  this section shall pay a fine of fifty dollars for the first offense and

    12  a fine of one hundred dollars for each subsequent offense. Any minor who
    13  is  sixteen years of age, who violates the provisions of subdivision one
    14  of this section shall be jointly and severally liable with  his  or  her
    15  parent or legal guardian for the fine imposed.
    16    §  2.  This  act  shall take effect on the sixtieth day after it shall
    17  have become a law.
