          the Committee on Insurance
 
        AN  ACT  to  direct the insurance department to study, evaluate and make
          recommendations concerning the provision  of  long  term  health  care
          insurance coverage and claims settlement in the state
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The insurance department is hereby authorized and  directed
     2  to  examine,  evaluate and make recommendations concerning the provision
     3  of long term health care insurance coverage in this state, as authorized
     4  pursuant to section 1117 of the insurance  law.  Such  department  shall
     5  review,  with  particular  care,  the claims settlement practices of the
     6  insurers providing such coverage in this state.
     7    § 2. The insurance department shall hold public hearings in the course
     8  of conducting its examination and evaluation pursuant to this act.
     9    § 3. The insurance department shall submit  a  report,  on  or  before
    10  January  1,  2012,  to the superintendent of insurance, the governor and

    11  the legislature of its findings, conclusions  and  recommendations,  and
    12  shall  submit  with its report such legislative and regulatory proposals
    13  as it deems necessary to implement its recommendations.
    14    § 4. This act shall take effect immediately.
