Authorizes the department of education to establish rules and regulations providing for the certification of chiropractors as acupuncturists, provided that such rules and regulations are no more or less restrictive than those applying to physicians and dentists and that such certified acupuncturists do not represent themselves as licensed acupuncturists.

AN ACT to amend the education law, in relation to the certification of
chiropractors as acupuncturists
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 3 of section 8216 of the education law, as
2 added by chapter 772 of the laws of 1990, is amended to read as follows:
3 (3) Any person who is validly certified under the provisions of the
4 former chapter nine hundred fifty-nine of the laws of nineteen hundred
5 seventy-four shall continue to be certified to practice acupuncture and
6 may continue to use the title certified acupuncturist. The department
7 may establish rules and regulations providing for the certification of
8 physicians and dentists as acupuncturists, provided that such certified
9 acupuncturists do not represent themselves as licensed acupuncturists.
10 The department shall establish rules and regulations providing for the
11 certification of chiropractors as acupuncturists, provided that such
12 rules and regulations are no more or less restrictive than those apply-
13 ing to physicians and dentists and that such certified acupuncturists do
14 not represent themselves as licensed acupuncturists. Certified acupunc-
15 turists seeking to become licensed acupuncturists shall be subject to
16 all provisions of this article;
17 § 2. This act shall take effect immediately.
