          tee on Education
 
        AN  ACT  to amend the education law, in relation to educational programs
          for certain non-English speaking pupils in a city having a  population
          of one million or more
 
          The  People of the State of New York, represented in Senate and Assem-

        bly, do enact as follows:
 
     1    Section 1.  Section 3204 of the education law is amended  by adding  a
     2  new subdivision 6 to read as follows:
     3    6.    Notwithstanding any other provision of law to the contrary, in a
     4  school district in a city having a population of one  million  or  more,
     5  there  shall  be  employed  in  every elementary school with non-English
     6  speaking pupils at least one teacher who is licensed  as  a  teacher  of
     7  English as a second language for every fifty non-English speaking pupils
     8  or  fraction  thereof,  in accordance with regulations prescribed by the
     9  commissioner consistent with this subdivision.
    10    § 2. This act shall take effect on the one hundred twentieth day after
    11  it shall have become a law. Effective immediately, the addition,  amend-

    12  ment  and/or repeal of any rules or regulations necessary for the imple-
    13  mentation of this act on its effective date are authorized to be made on
    14  or before such effective date.
