        AN ACT to amend the military law,  in  relation  to  retirement  age  of

          certain members of the New York guard
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Subdivision 1 of section 21 of the military law, as amended
     2  by chapter 122 of the laws of 1983, is amended to read as follows:
     3    1. Any commissioned officer or warrant officer of the organized  mili-
     4  tia,  apart  from  the New York guard, who has reached the age of sixty-
     5  eight years shall be retired  for  age  and  transferred  to  the  state
     6  retired list by the governor; provided, that any commissioned officer or
     7  warrant  officer  of  the organized militia may be retired for age at an
     8  age less than sixty-eight years in order to conform with  the  laws  and
     9  regulations of the United States applicable to the organized militia and

    10  may be transferred to the state retired list by the governor.  Officers,
    11  warrant  officers,  and enlisted members of the New York guard may serve
    12  until they have reached the age of seventy-five  years,  at  which  time
    13  they  shall be retired for age and transferred to the state retired list
    14  by the governor.
    15    § 2. This act shall take effect immediately.
