        AN ACT providing for the office  of  children  and  family  services  to
          undertake  a  study  on  the  feasibility  of implementing a statewide
          foster care passport program and to establish pilot programs  relating
          thereto
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The office of children and family services shall  undertake
     2  a  study  on  the  feasibility  of implementing a statewide foster child
     3  passport program.
     4    § 2. 1. Notwithstanding any other provision of law  to  the  contrary,
     5  during  the undertaking of such study, the office of children and family
     6  services shall create pilot programs in various regions across the state
     7  and then monitor the progress of such pilot programs in order to  assess
     8  their effectiveness.

     9    2.  Such  pilot programs shall issue a foster child passport to foster
    10  children when they are placed in foster care. The foster child  passport
    11  shall:
    12    (a) maintain a record of medical care provided to a foster child;
    13    (b)  aid a medical professional in giving appropriate care to a foster
    14  child; and
    15    (c) allow foster parents to authorize routine  and  emergency  medical
    16  care to a foster child.
    17    3. The foster child passport shall remain with a foster child until he
    18  or she is:
    19    (a) returned to his or her natural parents;
    20    (b) adopted; or

     1    (c) placed in another permanent plan.
     2    Upon  the occurrence of one of the paragraphs of this subdivision, the
     3  foster child passport shall be returned to  the  local  social  services
     4  district.
     5    §  3. The office of children and family services shall submit a report
     6  to the governor and the state legislature within one year of the  effec-
     7  tive date of this act that shall:
     8    (a) detail the cost and effectiveness of such a program; and
     9    (b)  make  recommendations  and policy suggestions as to the expansion
    10  and continuance of such a program.
    11    § 4. This act shall take effect on the one hundred eightieth day after
    12  it shall have become a law; provided, however, that effective immediate-
    13  ly, the addition, amendment and/or repeal  of  any  rule  or  regulation
    14  necessary  for  the implementation of this act on its effective date are

    15  authorized and directed to be made  and  completed  on  or  before  such
    16  effective date.
